On 31 October 2026, the extended deadline for Tax Year 2026 income tax returns passed. For a property buyer or seller, that date was not only about a return. It decided which tax rate applies to the next deal. The same house, at the same price, on the same day, can carry a tax bill several times higher for a non-filer than for a filer. The difference sits in the advance tax collected at transfer, under two sections every buyer and seller should know by number: 236K for the buyer and 236C for the seller.
What filer actually means
A filer is a person whose name appears on the Federal Board of Revenue Active Taxpayers List, known as the ATL, by filing the return for the relevant year. A non-filer is anyone not on the ATL: never registered, registered but did not file, or filed late and not yet back on the list.
The Tax Year 2026 deadline for individuals was originally 30 September 2026, then extended to 15 October, then to 31 October 2026 under FBR Circular No. 4 of 2026-27. On 31 October, the Pakistan Tax Bar Association asked for 34 more days. Business Recorder reported that day that FBR sources said there would be no further extension. No third extension had been announced at the time of writing, so check the current FBR notice before you act.
The 2026-27 card, updated to 30 June 2026 under the Finance Act 2026, has only ATL and non-ATL columns for property, with no separate late filer rate. Published guides report a late filer must also pay the section 182A surcharge, reported at PKR 25,000 for an individual, before joining the ATL.
The two taxes, side by side
A transfer triggers two separate advance taxes at the same time, on the same taxable value, at the registrar. They arrive together, so they are often confused, but they are charged to different people.
Section 236K is the buyer's advance tax. For Tax Year 2026-27, the filer rate is a flat 1.25 percent, whatever the property is worth. The non-filer rate is banded: 10.5 percent up to PKR 50 million, 14.5 percent from PKR 50 million to PKR 100 million, and 18.5 percent above PKR 100 million. Section 236C is the seller's advance tax at the same transfer. The filer rate is a flat 2.75 percent, and the non-filer rate is a flat 11.5 percent. One published calculator quotes 11 percent for the 236C non-filer rate, so get that figure confirmed in writing on the payment day rather than relying on any single guide, including this one.
Both are advance taxes, not the final tax. For a filer, the amount paid is adjustable against the final annual liability, so it is not simply lost. The Finance Act 2026 also abolished the section 7E deemed income tax on immovable property. That removes one hurdle, but not 236C or 236K. This guide is not tax advice for any individual case.
What it costs in rupees
Percentages hide the gap. Rupees show it. On a property with a taxable value of PKR 20 million, a filer buyer pays 1.25 percent under 236K, which is PKR 250,000, while a non-filer buyer pays 10.5 percent, which is PKR 2,100,000. On the same property, a filer seller pays 2.75 percent under 236C, which is PKR 550,000, while a non-filer seller pays 11.5 percent, which is PKR 2,300,000. If both sides are non-filers, the combined advance tax is PKR 4,400,000, against PKR 800,000 if both are filers: PKR 3,600,000 more on one deal, before stamp duty, registration and society charges.
The buyer gap grows with value, because the non-filer 236K rate rises through its bands while the filer rate stays flat. On a PKR 60 million property, a filer buyer pays PKR 750,000, while a non-filer buyer pays 14.5 percent, which is PKR 8,700,000. These are worked examples on the taxable value, not promises for any single deal, because the taxable value itself must be confirmed first.
If you missed the deadline, and five checks before you sign
Missing the deadline means neither giving up on filer status nor assuming it. File now, late rather than never, and keep the acknowledgment. Check whether a surcharge applies, pay it if it does, then check your ATL status on the FBR portal and keep a dated copy. Do not rely on a filing receipt alone. Only then price the deal at the filer rate. If the deal must complete first, budget the non-filer rate.
The same discipline applies to the other side. A seller quoting a low tax figure may be quoting the filer rate while standing as a non-filer, or quoting an old rate from a previous year. Ask for the status and the calculation, not only the headline figure. Before you sign, confirm ATL status for both sides close to the transfer date; get both calculations in writing, showing value, rate and amount; confirm which value the registrar will use; check for later amendments; and verify title, possession, society record and dues. A low tax bill on a disputed property is not a bargain.
Frequently asked questions
Who pays 236K and who pays 236C?
The buyer pays 236K and the seller pays 236C. Both are collected at the same transfer, on the same taxable value, but they are two separate taxes.
What are the filer rates for 2026-27?
The filer buyer rate under 236K is a flat 1.25 percent, and the filer seller rate under 236C is a flat 2.75 percent, under the Finance Act 2026. Confirm both on the payment day, because rates change through later notifications.
What do non-filers pay on a property deal?
A non-filer buyer pays 10.5 percent up to PKR 50 million, 14.5 percent to PKR 100 million, and 18.5 percent above that under 236K. A non-filer seller pays a flat 11.5 percent under 236C. One calculator quotes 11 percent, so confirm the seller figure in writing.
Does filing late restore the filer rate immediately?
No. Late filing must be followed by the section 182A surcharge before the name is added to the ATL, and the 2026-27 card has no separate late filer rate. Check your ATL status before relying on the filer rate.
The bottom line
In 2026, filer status is not paperwork for another day. It is a direct cost on the deal in front of you, measured in lakhs on an ordinary house and in crores on a high value property. File, confirm ATL status, get both calculations in writing, and price the deal on the status each side holds on the transfer date.
