SHC raises concerns over frequent transfers in SBCA

According to the news sources, Sindh high court said that this has also been affecting compliance with the court’s orders. Frequent transfers of public servants will affect their morale, and weaken the administration, which cannot be termed good governance. The Sindh High Court also directed the SBCA chief to appear in person for an explanation.

While hearing a petition of Mohammad Akram Paracha against an unauthorized construction in District South, an SHC division bench comprising Justice Zafar Ahmed Rajput and Justice Mohammad Faisal Kamal Alam said that various court orders on unauthorized constructions have been frustrated due to SBCA officers’ frequent transfers.

According to the news sources, the judiciary bench said that in many consecutive petitions on the subject of illegal constructions, various orders have been issued by the SHC for compliance with its orders, which are being frustrated by way of making frequent transfers or postings of the relevant SBCA officers.

Several orders of the court have not been complied with due to the frequent transfers and postings of the authority’s officers. Sindh high court, question the SBCA performance.

The Sindh Building Control Authority district director said the authority reallocated directors of different districts, resulting in him being transferred from District South to District East, and just a day earlier, he was transferred to District Malir. He asked for the present District South director to be told to file the compliance report.

The bench said that neither had the building control authority’s director for District South appeared in court nor had the orders of the SHC been fulfilled. The court said that in the instant case, the above-mentioned officer has been transferred twice in three weeks, which has not only delayed and impeded compliance with the SHC’s orders issued on November 10 but also amounts to defiance of the orders.

The SHC bench directed the SBCA director general to appear in person, along with a comprehensive report on compliance with the court’s orders. The SHC directed the office to communicate a copy of the order to the local government secretary as well as the SBCA chief.

Karachi Development Authority chief’s transfer

The SHC also directed the provincial law officer to file comments on a petition against the transfer of Chief Asif Ali Memon Karachi Development Authority (KDA). Memon said in his petition that within three months of his employment as the authority’s DG, he was transferred after he was assigned several tasks by the Supreme Court for the removal of violations from amenity plots in the city.

In terms of Article 212 of the constitution, and sections 4 and 10 of the Sindh Civil Servants Act the Sindh advocate general questioned the maintainability of the petition. He also sought time to file comments on the petition.

The court adjourned the matter until December 23, directing the petitioner’s counsel to come prepared to satisfy the court on the maintainability of the petition in respect of the contention raised by the AG.

نیوز ذرائع کے مطابق سندھ ہائی کورٹ نے کہا کہ اس سے عدالتی احکامات کی تعمیل بھی متاثر ہو رہی ہے۔ سرکاری ملازمین کے بار بار تبادلوں سے ان کے حوصلے متاثر ہوں گے، اور انتظامیہ کمزور ہو گی، جسے گڈ گورننس نہیں کہا جا سکتا۔ سندھ ہائی کورٹ نے ایس بی سی اے کے سربراہ کو وضاحت کے لیے ذاتی حیثیت میں پیش ہونے کی بھی ہدایت کی۔
ڈسٹرکٹ ساؤتھ میں غیر مجاز تعمیرات کے خلاف محمد اکرم پراچہ کی درخواست کی سماعت کرتے ہوئے جسٹس ظفر احمد راجپوت اور جسٹس محمد فیصل کمال عالم پر مشتمل سندھ ہائی کورٹ کے ڈویژن بنچ نے کہا کہ ایس بی سی اے افسران کے متواتر تبادلوں کی وجہ سے غیر مجاز تعمیرات سے متعلق عدالتی احکامات مایوسی کا شکار ہیں۔
نیوز ذرائع کے مطابق عدالتی بنچ نے کہا کہ غیر قانونی تعمیرات کے موضوع پر لگاتار کئی درخواستوں میں سندھ ہائی کورٹ کی جانب سے اپنے احکامات کی تعمیل کے لیے مختلف احکامات جاری کیے گئے ہیں، جن میں متواتر تبادلے یا تقرریوں کے ذریعے مایوسی کا اظہار کیا جا رہا ہے۔ متعلقہ (ایس بی سی اے) افسران۔

سندھ بلڈنگ کنٹرول اتھارٹی کے ضلعی ڈائریکٹر نے کہا کہ اتھارٹی نے مختلف اضلاع کے ڈائریکٹرز کو دوبارہ مختص کیا، جس کے نتیجے میں انہیں ڈسٹرکٹ ساؤتھ سے ڈسٹرکٹ ایسٹ میں تبدیل کر دیا گیا، اور صرف ایک دن قبل انہیں ڈسٹرکٹ ملیر میں تبدیل کر دیا گیا۔ انہوں نے موجودہ ڈسٹرکٹ ساؤتھ ڈائریکٹر کو تعمیل رپورٹ داخل کرنے کے لیے کہا۔ بنچ نے کہا کہ نہ تو بلڈنگ کنٹرول اتھارٹی کے ڈائریکٹر ڈسٹرکٹ ساؤتھ عدالت میں پیش ہوئے اور نہ ہی سندھ ہائی کورٹ کے احکامات کی تعمیل کی گئی۔ عدالت نے کہا کہ فوری کیس میں، مذکورہ افسر کا تین ہفتوں میں دو بار تبادلہ کیا گیا ہے، جس سے نہ صرف 10 نومبر کو ایس ایچ سی کے جاری کردہ احکامات کی تعمیل میں تاخیر اور رکاوٹ پیدا ہوئی ہے بلکہ یہ احکامات کی خلاف ورزی کے مترادف ہے۔
ایس ایچ سی بنچ نے ایس بی سی اے کے ڈائریکٹر جنرل کو عدالت کے احکامات کی تعمیل کے بارے میں جامع رپورٹ کے ساتھ ذاتی طور پر پیش ہونے کی ہدایت کی۔ ایس ایچ سی نے دفتر کو حکم کی ایک کاپی مقامی حکومت کے سیکرٹری کے ساتھ ساتھ ایس بی سی اے کے سربراہ کو بھیجنے کی ہدایت کی۔
کراچی ڈیولپمنٹ اتھارٹی کے سربراہ کا تبادلہ
سندھ ہائی کورٹ نے صوبائی لاء آفیسر کو چیف آصف علی میمن کراچی ڈیولپمنٹ اتھارٹی (کے ڈی اے) کے تبادلے کے خلاف درخواست پر تبصرہ کرنے کی بھی ہدایت کی۔ میمن نے اپنی درخواست میں کہا کہ اتھارٹی کے ڈی جی کی حیثیت سے اپنی ملازمت کے تین ماہ کے اندر ان کا تبادلہ اس وقت کیا گیا جب انہیں سپریم کورٹ کی جانب سے شہر میں سہولتی پلاٹوں سے تجاوزات کے خاتمے کے لیے متعدد کام تفویض کیے گئے۔

سندھ کے ایڈووکیٹ جنرل نے آئین کے آرٹیکل 212 اور سندھ سول سرونٹ ایکٹ کے سیکشن 4 اور 10 کے مطابق پٹیشن کی برقراری پر سوال اٹھایا۔ انہوں نے درخواست پر تبصرہ کرنے کے لیے بھی وقت مانگا ہے۔
عدالت نے درخواست گزار کے وکیل کو ہدایت کی کہ وہ اے جی کی طرف سے اٹھائے گئے اعتراض کے سلسلے میں پٹیشن کی برقراری پر عدالت کو مطمئن کرنے کے لیے تیار رہیں، کیس کی سماعت 23 دسمبر تک ملتوی کر دی۔
