SHC orders DHA to share land allotment and reclamation

According to the news sources. After the official assignee complained that the DHA was not willing to provide the requisite document.  The Sindh High Court on Wednesday directed the DHA to provide records and documents of all the land allotted including the land reclaimed from the sea.

These orders are given by A single-judge bench which is headed by Justice Zulfiqar Ahmad Khan.  SHC also allotted notices to the DHA, Cantonment Board Clifton, Cantonment Board Faisal, Cantonment Board Malir, Karachi Cantonment Board, and others for Dec 15 on an application seeking contempt proceedings against them for not complying with the court’s earlier order warning them not to use the land authorized as public spaces for any commercial and gainful purposes and also not to create a third-party interest.

According to the sources, the bench also ordered the DHA to share the record of the land allotted for other projects and further ordered the Civil Aviation Authority and Port Qasim Authority to provide the record of commercial properties and reclaimed land, respectively.

This bench also asked the Sindh government to appoint focal persons to supply relevant information to the official assignee about ownership and possession of the reclaimed land. For this purpose, the bench gives two weeks to the authority to furnish requisite documents.

نیوز ذرائع کے مطابق… سرکاری تفویض کرنے والے کی شکایت کے بعد کہ (ڈی ایچ اے) مطلوبہ دستاویز فراہم کرنے کو تیار نہیں ہے۔ بدھ کو سندھ ہائی کورٹ نے ڈی ایچ اے کو سمندر سے دوبارہ حاصل کی گئی زمین سمیت الاٹ کی گئی تمام اراضی کا ریکارڈ اور دستاویزات فراہم کرنے کی ہدایت کی۔
یہ احکامات جسٹس ذوالفقار احمد خان کی سربراہی میں سنگل جج بنچ نے دیے ہیں۔ ایس ایچ سی نے ڈی ایچ اے، کنٹونمنٹ بورڈ کلفٹن، کنٹونمنٹ بورڈ فیصل، کنٹونمنٹ بورڈ ملیر، کراچی کنٹونمنٹ بورڈ اور دیگر کو 15 دسمبر کے لیے نوٹس بھی الاٹ کیے ہیں جس میں عدالت کے پہلے حکم کی تعمیل نہ کرنے پر ان کے خلاف توہین عدالت کی کارروائی کی درخواست کی گئی ہے کسی بھی تجارتی اور فائدہ مند مقاصد کے لیے عوامی جگہوں کے طور پر مجاز زمین اور تیسرے فریق کی دلچسپی پیدا نہ کرنے کے لیے۔
ذرائع کے مطابق بنچ نے ڈی ایچ اے کو دیگر منصوبوں کے لیے الاٹ کی گئی زمین کا ریکارڈ بھی شیئر کرنے کا حکم دیا اور مزید حکم دیا کہ سول ایوی ایشن اتھارٹی اور پورٹ قاسم اتھارٹی کو بالترتیب کمرشل پراپرٹیز اور دوبارہ حاصل کی گئی زمین کا ریکارڈ فراہم کیا جائے۔
اس بنچ نے سندھ حکومت سے یہ بھی کہا کہ وہ فوکل پرسنز کا تقرر کرے تاکہ وہ سرکاری تفویض کرنے والے کو دوبارہ دعوی کردہ زمین کی ملکیت اور قبضے کے بارے میں متعلقہ معلومات فراہم کرے۔ اس مقصد کے لیے بنچ نے اتھارٹی کو مطلوبہ دستاویزات پیش کرنے کے لیے دو ہفتے کا وقت دیا ہے۔
