SHC directs KMC to stop encroachment or illegal construction on Lyari park

The Sindh High Court has directed the Karachi Metropolitan Corporation, and others to take strict, and effective steps to protect Ismail Shaheed Park in Lyari against any encroachment or illegal construction.

The order came on a petition of Zohra Begum against encroachment at the public park situated in Shah Baig Lane, Block 1, Lyari.

The petitioner’s counsel, Ziaul Haq Makhdoom, submitted in the petition that residents of the area had made the park functional a couple of years ago, but certain corrupt persons demolished the road-facing wall of the park and tried to encroach upon the park.

The counsel submitted the authorities had been approached with regard to the illegal construction, and encroachment on the land of the park, but to no avail.

He said the official respondents had failed to take any appropriate action to prevent the encroachment, and illegal construction, and conversion of the status of the amenity plot. He requested the court to stop the respondents from such illegal acts.

 A division bench, headed by Justice Syed Hasan Azhar Rizvi, after the preliminary hearing of the petition, issued notices to the KMC and others, and in the meantime directed them to take appropriate steps to prevent the encroachment, illegal construction, and utilization of park for other purposes.

The court directed the official respondents to submit a comprehensive report on it within 10 days.

کراچی: سندھ ہائیکورٹ نے لیاری پارک پر تجاوزات یا غیرقانونی تعمیرات روکنے کے لئے سخت کارروائی کرنے کی ہدایت کی ہے۔

سندھ ہائی کورٹ نے کراچی میٹرو پولیٹن کارپوریشن ، اور دیگر کو ہدایت کی ہے کہ وہ کسی بھی تجاوزات یا غیر قانونی تعمیر کے خلاف لیاری میں اسماعیل شہید پارک کے تحفظ کے لئے سخت اور موثر اقدامات کریں۔

یہ حکم لیاری کے بلاک 1 ، شاہ بیگ لین میں واقع عوامی پارک میں تجاوزات کے خلاف زہرہ بیگم کی درخواست پر آیا ہے۔

درخواست گزار کے وکیل ضیاءالحق مخدوم نے درخواست میں عرض کیا ہے کہ علاقے کے رہائشیوں نے کچھ سال پہلے ہی پارک کو فعال بنایا تھا ، لیکن بعض بدعنوان افراد نے پارک کی سڑک والی دیوار کو منہدم کرکے پارک کو تجاوزات کرنے کی کوشش کی تھی۔

مشیر نے عرض کیا کہ پارک کی زمین پر غیر قانونی تعمیرات اور تجاوزات کے سلسلے میں احکام سے رجوع کیا گیا تھا ، لیکن فائدہ نہیں ہوا۔

انہوں نے کہا کہ سرکاری جواب دہندگان تجاوزات ، اور غیرقانونی تعمیرات ، اور سہولت سازشی پلاٹ کی حیثیت کو تبدیل کرنے کے لئے کوئی مناسب اقدام اٹھانے میں ناکام رہے ہیں۔

انہوں نے عدالت سے استدعا کی کہ وہ جواب دہندگان کو اس طرح کی غیر قانونی حرکتوں سے باز رکھیں۔

جسٹس سید حسن اظہر رضوی کی سربراہی میں ڈویژن بینچ نے درخواست کی ابتدائی سماعت کے بعد کے ایم سی اور دیگر کو نوٹسز جاری کردیئے ، اور اس دوران انھیں تجاوزات ، غیرقانونی تعمیرات اور پارک کے استعمال کو روکنے کے لئے مناسب اقدامات کرنے کی ہدایت کی۔

عدالت نے سرکاری جواب دہندگان کو ہدایت کی کہ وہ اس بارے میں ایک جامع رپورٹ 10 دن میں پیش کریں۔
