SC orders Nasla Tower builders to refund money to buyers in 3 months

The Supreme Court has directed the builders of the 15-story Nasla Tower to refund the amount to the registered buyers of residential, and commercial units within three months.

The apex court further said that in case of any delay in payment, the applicants may claim profit at the bank rate together with damages, and initiate proceedings for implementation of this order before the court of competent jurisdiction.

On June 16, a three-judge SC bench headed by Chief Justice of Pakistan Gulzar Ahmed had ordered the demolition of the 15-story building for encroaching on the land meant for a service road and issued its detailed order.

The bench in its judgment said, “After examining the entire record, and examining the reports submitted by all concerned agencies, and departments, we are in no manner of doubt that the tower in question (Nasla Tower) has indeed been constructed on encroached land which amongst other things has also blocked a service road.”

The owners of the tower claimed that the additional area was allotted by SMCHS through a resolution in 2010, and the same came to be included in the total area of the plot.

 While the mukhtiarkar in his report said that SMCHS had illegally increased the size of the plot by allotting the land reserved for the service road, the order said.

سپریم کورٹ نے 15 منزلہ نیسلہ ٹاور کے بلڈروں کو رہائشیوں ، اور تجارتی یونٹوں کے رجسٹرڈ خریداروں کو تین ماہ کے اندر رقم واپس کرنے کی ہدایت کی ہے۔

عدالت عظمیٰ نے مزید کہا کہ ادائیگی میں تاخیر کی صورت میں ، درخواست گزار ہرجانہ کے ساتھ ساتھ بینک ریٹ پر منافع کا دعویٰ کرسکتے ہیں ، اور مجاز دائرہ اختیار کی عدالت کے روبرو اس حکم پر عمل درآمد کے لئے کارروائی کا آغاز کرسکتے ہیں۔

16 جون کو ، چیف جسٹس آف پاکستان گلزار احمد کی سربراہی میں تین ججوں پر مشتمل ایس سی بینچ نے سروس روڈ کے لئے اراضی پر تجاوزات کرنے کے لئے 15 منزلہ عمارت کو منہدم کرنے کا حکم دیا تھا اور اس کا تفصیلی حکم جاری کیا تھا۔

بنچ نے اپنے فیصلے میں کہا ، "پورے ریکارڈ کی جانچ پڑتال کے بعد ، اور تمام متعلقہ ایجنسیوں اور محکموں کی پیش کردہ رپورٹس کی جانچ پڑتال کے بعد ، ہمیں اس میں کوئی شک نہیں ہے کہ واقعی ٹاور (نیسلا ٹاور) تجاوزات والی زمین پر تعمیر کیا گیا ہے۔ جس نے دوسری چیزوں میں سے ایک سروس روڈ بھی بند کردیا ہے۔

ٹاور کے مالکان نے دعوی کیا کہ اضافی رقبہ 2010 میں ایک قرارداد کے ذریعے ایس ایم سی ایچ ایس نے الاٹ کیا تھا ، اور اسی کو پلاٹ کے کل رقبے میں شامل کیا گیا تھا۔

جبکہ مختارکر نے اپنی رپورٹ میں کہا ہے کہ ایس ایم سی ایچ ایس نے سروس روڈ کے لئے مختص اراضی الاٹ کرکے پلاٹ کے سائز میں غیر قانونی اضافہ کردیا ہے۔
