SC orders de-sealing of Monal Restaurant

According to the news sources, “The unsigned order of the IHC will remain suspended,” ordered a three-judge Supreme Court bench headed by Justice Ijaz-ul-Ahsan. Consequently, the Monal Restaurant will be de-sealed.

The court which had taken up the appeal of Monal Group of Companies however wondered why no action was taken against other 13 restaurants situated at the close proximity of the Monal Restaurant like the La-Montana, Gloria Jeans, etc., and why Monal was discriminated against only and on what basis its possession was taken over without the certified copy of the high court.

According to the details, the court was surprised over the way the possession of the restaurant was taken over in haste without any written order of the high court also wondering how many restaurants on the Margalla Hills have been sealed.

The Supreme Court (SC) suspended Islamabad High Court’s (IHC) verdict in the Monal Restaurant case and ordered those authorities de-seal the restaurant in the capital.

اسلام آباد: سپریم کورٹ نے بدھ کے روز مونال ریسٹورنٹ کو سیل کرنے اور قبضے میں لینے کے اسلام آباد ہائی کورٹ کے 11 جنوری کے فیصلے کو معطل کردیا۔
نیوز ذرائع کے مطابق، جسٹس اعجاز الاحسن کی سربراہی میں سپریم کورٹ کے تین رکنی بینچ نے حکم دیا کہ "آئ ایچ سی کا غیر دستخط شدہ حکم نامہ معطل رہے گا۔" نتیجتاً مونال ریسٹورنٹ کو ڈی سیل کر دیا جائے گا۔
عدالت جس نے مونال گروپ آف کمپنیز کی اپیل کی سماعت کی تاہم حیرانگی کا اظہار کیا کہ مونال ریسٹورنٹ کے قریب واقع لا مونٹانا، گلوریا جینز وغیرہ جیسے دیگر 13 ریستورانوں کے خلاف کوئی کارروائی کیوں نہیں کی گئی اور مونال کے ساتھ امتیازی سلوک کیوں کیا گیا۔ صرف اور کس بنیاد پر اس کا قبضہ ہائی کورٹ کی مصدقہ کاپی کے بغیر لیا گیا۔
تفصیلات کے مطابق ہائی کورٹ کے تحریری حکم نامے کے بغیر جس طرح عجلت میں ریسٹورنٹ پر قبضہ کیا گیا اس پر عدالت نے بھی حیرانگی کا اظہار کرتے ہوئے کہا کہ مارگلہ ہلز پر کتنے ریسٹورنٹس کو سیل کیا گیا ہے۔
سپریم کورٹ نے مونال ریسٹورنٹ کیس میں اسلام آباد ہائی کورٹ (آئ ایچ سی) کے فیصلے کو معطل کرتے ہوئے ان حکام کو دارالحکومت کے ریسٹورنٹ کو ڈی سیل کرنے کا حکم دے دیا۔
