SC directs DHA Lahore to share its new site’s master plan with RUDA

The Supreme Court (SC) Thursday directed the Defence Housing Authority (DHA) Lahore to share the master plan of its new site with Ravi Urban Development Authority (RUDA).

A two-member SC bench comprising Justice Ijazul Ahsen and Justice Syed Mazahir Ali Akbar Naqvi heard a suo moto case regarding granting of permission to the DHA Lahore for development on its new site, as well as the affectees of Eden Garden Housing Society.

The court directed the Defence Housing Authority Lahore to also decide the matter of giving plots to affectees of Eden Garden Housing Society in the DHA or return the paid amounts.

The court raised questions over the performance of the RUDA. Justice Ijazul Ahsen observed that the affairs of RUDA were in mess. The judge questioned as to it was making any progress or fighting cases.

“Whether the housing society, being developed by the DHA comes under the administration of Ravi Urban Development Authority,” the judge asked.

Justice Ahsen further asked whether the DHA would get the land after fulfilling all the conditions of the Ravi Urban Development Authority.

The court ordered for submitting order sheet of the Lahore High Court besides submitting the viewpoint of over a hundred affectees of Eden Garden Housing Society before it.

Counsel for the Ravi Urban Development Authority told the court that the DHA land was transferred from the Lahore Development Authority to Ravi Urban Development Authority; however, the learned high court had restrained the Ravi Urban Development Authority from development work.

The counsel submitted that due to the stay granted by the Lahore High Court, RUDA could not continue its work and was facing the cases.`

اسلام آباد: سپریم کورٹ نے ڈی ایچ اے لاہور کو ہدایت کی ہے کہ وہ اپنی نئی سائٹ کا ماسٹر پلان راوی اربن ڈویلپمنٹ اتھارٹی کے ساتھ شیئر کرے۔

سپریم کورٹ نے جمعرات کو ڈیفنس ہاؤسنگ اتھارٹی (ڈی ایچ اے) لاہور کو ہدایت کی کہ وہ اپنی نئی سائٹ کا ماسٹر پلان راوی اربن ڈویلپمنٹ اتھارٹی (روڈا) کے ساتھ شیئر کرے۔

جسٹس اعجاز الاحسن اور جسٹس سید مظاہر علی اکبر نقوی پر مشتمل دو رکنی سپریم کورٹ کے بینچ نے ڈی ایچ اے لاہور کو اپنی نئی سائٹ پر ترقی کے لیے اجازت دینے کے ساتھ ساتھ ایڈن گارڈن ہاؤسنگ سوسائٹی کے متاثرین سے متعلق ازخود نوٹس کیس کی سماعت کی۔

عدالت نے ڈیفنس ہاؤسنگ اتھارٹی لاہور کو ہدایت کی کہ وہ ڈی ایچ اے میں ایڈن گارڈن ہاؤسنگ سوسائٹی کے عاملوں کو پلاٹ دینے یا ادا کی گئی رقم واپس کرنے کا معاملہ بھی طے کرے۔

عدالت نے روڈا کی کارکردگی پر سوالات اٹھائے۔ جسٹس اعجازالاحسن نے مشاہدہ کیا کہ روڈا کے معاملات گڑبڑ میں ہیں۔ جج نے سوال کیا کہ یہ کوئی پیش رفت کر رہا ہے یا مقدمات لڑ رہا ہے؟

جج نے پوچھا ، "کیا ڈی ایچ اے کی طرف سے تیار کی جانے والی ہاؤسنگ سوسائٹی راوی اربن ڈیولپمنٹ اتھارٹی کے زیر انتظام آتی ہے؟"

جسٹس احسن نے مزید پوچھا کہ کیا ڈی ایچ اے راوی اربن ڈیولپمنٹ اتھارٹی کی تمام شرائط پوری کرنے کے بعد زمین حاصل کرے گا؟

عدالت نے ایڈن گارڈن ہاؤسنگ سوسائٹی کے سو سے زائد متاثرین کا نظریہ پیش کرنے کے علاوہ لاہور ہائی کورٹ کا آرڈر شیٹ جمع کرانے کا حکم دیا۔

راوی اربن ڈیولپمنٹ اتھارٹی کے وکیل نے عدالت کو بتایا کہ ڈی ایچ اے کی زمین لاہور ڈویلپمنٹ اتھارٹی سے راوی اربن ڈیولپمنٹ اتھارٹی کو منتقل کی گئی۔ تاہم ، ہائی کورٹ نے راوی اربن ڈویلپمنٹ اتھارٹی کو ترقیاتی کاموں سے روک دیا تھا۔

وکیل نے کہا کہ لاہور ہائیکورٹ کی جانب سے دی گئی روک کی وجہ سے روڈا اپنا کام جاری نہیں رکھ سکا اور مقدمات کا سامنا کر رہا ہے۔
