SC directs demolition of Karachi's Nasla Tower within a week

The Supreme Court (SC) directed the Karachi commissioner to demolish Nasla Tower, a 15-storey residential building located at the intersection of Shara-e-Faisal and Shahrah-i-Quaideen, through "controlled blasting" within a week and submit a report.

The matter was taken up by a three-member bench, headed by Chief Justice of Pakistan (CJP) Gulzar Ahmed and comprising Justice Ijaz-ul-Ahsan and Justice Qazi Muhammad Amin Ahmed, at the SC's Karachi registry, where the city commissioner appeared before the court.

The court further instructed the commissioner to ensure that no harm was caused to other buildings and persons in Nasla Tower's vicinity because of the blast.

It also directed the builder of Nasla Tower to refund money to registered buyers of the residential and commercial units, adding that the city commissioner should ensure that the refunds were made.

A three-judge SC bench, led by Chief Justice of Pakistan Gulzar Ahmed, had initially ordered the demolition of the 15-storey building for encroaching on the land meant for a service road on June 16.

Issuing a detailed order for the same on June 19, the court had also directed the builders of Nasla Tower to refund the amount to the registered buyers of residential and commercial units within three months.

The court had said in its judgment that “After examining the entire record and scrutinizing the reports submitted by all concerned agencies and departments, we are in no manner of doubt that the tower in question (Nasla Tower) has indeed been constructed on encroached land which amongst other things has also blocked a service road.”

“Being illegal construction and there being no provision for compounding such illegality especially where a service road has been blocked, the same is liable to be demolished,” it had added.

سپریم کورٹ (ایس سی) نے کمشنر کراچی کو شارع فیصل اور شاہراہ قائدین کے چوراہے پر واقع 15 منزلہ رہائشی عمارت نسلہ ٹاور کو ایک ’’کنٹرولڈ بلاسٹنگ‘‘ کے ذریعے گرا کر رپورٹ پیش کرنے کا حکم دیا۔

اس معاملے کی سماعت چیف جسٹس آف پاکستان (سی جے پی) گلزار احمد کی سربراہی میں جسٹس اعجاز الاحسن اور جسٹس قاضی محمد امین احمد پر مشتمل تین رکنی بینچ نے سپریم کورٹ کراچی رجسٹری میں کی، جہاں سٹی کمشنر عدالت میں پیش ہوئے۔

عدالت نے کمشنر کو مزید ہدایت کی کہ وہ اس بات کو یقینی بنائیں کہ دھماکے سے نسلہ ٹاور کے آس پاس کی عمارتوں اور افراد کو کوئی نقصان نہ پہنچے۔

اس نے نسلا ٹاور کے بلڈر کو رہائشی اور تجارتی یونٹس کے رجسٹرڈ خریداروں کو رقم واپس کرنے کی بھی ہدایت کی، اور مزید کہا کہ سٹی کمشنر اس بات کو یقینی بنائے کہ رقم کی واپسی کی جائے۔

چیف جسٹس آف پاکستان گلزار احمد کی سربراہی میں سپریم کورٹ کے تین رکنی بینچ نے ابتدائی طور پر 16 جون کو سروس روڈ کے لیے بنائی گئی اراضی پر قبضہ کرنے پر 15 منزلہ عمارت کو گرانے کا حکم دیا تھا۔

19 جون کو اس کے لیے تفصیلی حکم جاری کرتے ہوئے عدالت نے نسلا ٹاور کے بلڈرز کو یہ بھی ہدایت کی تھی کہ وہ رہائشی اور کمرشل یونٹس کے رجسٹرڈ خریداروں کو تین ماہ کے اندر رقم واپس کر دیں۔

عدالت نے اپنے فیصلے میں کہا تھا کہ ’’پورے ریکارڈ کی جانچ پڑتال اور تمام متعلقہ ایجنسیوں اور محکموں کی جانب سے پیش کی گئی رپورٹس کی چھان بین کے بعد، ہمیں اس میں کوئی شک نہیں ہے کہ زیر بحث ٹاور (ناسلہ ٹاور) واقعتاً تجاوز شدہ زمین پر تعمیر کیا گیا ہے۔ دوسری چیزوں کے علاوہ ایک سروس روڈ کو بھی بلاک کر دیا ہے۔

"غیر قانونی تعمیر ہونے کی وجہ سے اور اس طرح کی غیر قانونی کو کمپاؤنڈ کرنے کا کوئی انتظام نہیں ہے خاص طور پر جہاں سروس روڈ کو بلاک کیا گیا ہے، اسی کو منہدم کرنے کا ذمہ دار ہے۔"
