SC denies stay against IHC's judgment in Park View City Housing Society

A two-judge bench comprising of Justice Umar Ata Bandial and Justice Muneeb Akhtar conducted the hearing against IHC’s judgment. Notices were issued to the respondents including the Capital Development Authority (CDA).

Justice Muneeb Akhtar questioned how the housing society obtained the NOC to which the Defence Counsel replied that NOCs were issued to many housing societiesafter the apex court’s order in 2008.

Justice Bandial said that the stay could not be granted because important questions have been raised in the judgment of the High Court. However, the bench accepted the appeal for further hearing.

Chief Justice IHC Athar Minallahalso declared in his judgment that the land acquired under the Ordinance of 1960, vests in the State and it cannot be used, directly or indirectly, in violation of the scheme and provisions thereof.

The bench also directed the CDA and the Chief Commissioner, Islamabad Capital Territory to remove all obstructions or any other construction attributed to the company on the acquired land. Moreover, the authority shall also forthwith resume the land so far developed by the company under regulation 22 of the Revised Modalities and Procedure, 2020.

اسلام آباد: سپریم کورٹ نے پارک ویو سوسائٹی کے این او سی کو بحال کرنے کے اسلام آباد ہائی کورٹ کے فیصلے کے خلاف روک دینے سے انکار کردیا۔

جسٹس عمر عطا بندیال اور جسٹس منیب اختر پر مشتمل دو ججوں کے بنچ نے آئی ایچ سی کے فیصلے کے خلاف سماعت کی۔ کیپیٹل ڈویلپمنٹ اتھارٹی (سی ڈی اے) سمیت جواب دہندگان کو نوٹسز جاری کردیئے گئے۔

جسٹس منیب اختر نے سوال کیا کہ ہاؤسنگ سوسائٹی نے این او سی کیسے حاصل کی جس کا دفاعی کونسل نے جواب دیا کہ سن 2008 میں عدالت عظمیٰ کے حکم کے بعد بہت سے ہاؤسنگ سوسائٹیوں کو این او سی جاری کردیئے گئے تھے۔

جسٹس بانڈیال نے کہا کہ یہ قیام نہیں ہوسکتا کیوں کہ ہائی کورٹ کے فیصلے میں اہم سوالات اٹھائے گئے ہیں۔ تاہم ، بینچ نے مزید سماعت کے لئے اپیل قبول کرلی۔

چیف جسٹس آئی ایچ سی اطہر من اللہ نے اپنے فیصلے میں یہ بھی اعلان کیا کہ 1960 کے آرڈیننس کے تحت حاصل کی گئی ریاست ، ریاست میں واسکٹ ہیں اور اس کا استعمال براہ راست یا بلاواسطہ اس اسکیم اور اس کی دفعات کی خلاف ورزی کرتے ہوئے نہیں کیا جاسکتا ہے۔

بنچ نے سی ڈی اے اور چیف کمشنر ، اسلام آباد کیپیٹل ٹیریٹری کو یہ بھی ہدایت کی کہ وہ حاصل شدہ اراضی پر کمپنی کو منسوب تمام رکاوٹوں یا کسی بھی دوسری تعمیر کو دور کرے۔ مزید یہ کہ اتھارٹی بھی جلد ہی کمپنی کے ذریعہ اب تک نظر ثانی شدہ طریقوں اور طریقہ کار ، 2020 کے ضابطہ 22 کے تحت تیار کی گئی زمین کو دوبارہ شروع کرے گی۔
