SBCA ordered to ensure fire dept’s NOC for approving building plan

The Sindh High Court (SHC) has ordered the Sindh Building Control Authority (SBCA) to come up with a standard operating procedure (SOP) for ensuring that various important measures are taken prior to the approval of any building plan.

Moreover, there will be implemented over the requirement of no-objection certificates (NOCs) that would be approved, before initiating the construction work of buildings, from the fire departments and the civil defense. 

Safety by-laws` implementation petition was announced, under the Building Code of Pakistan, and on hearing it, a division bench of the SHC led by Justice Mohammad Ali Mazhar inquired from the SBCA director general (DG) regarding the obedience to court orders.

The high court has ordered SBCA DG to arrange a meeting with the Civil Defence Department and Chief Fire Officer for bringing amendments in rules and regulations of issuing of NOC before the construction of high-rise buildings start in Karachi.

It was earlier informed by the High court that the three-tier task force on the district, sub-district, and divisional levels has been formulated for inspecting the high-rise buildings, industries as well as factories to make sure that all required safety measures are taken in these establishments or not.

سندھ ہائی کورٹ نے سندھ بلڈنگ کنٹرول اتھارٹی (ایس بی سی اے) کو حکم دیا ہے کہ کسی بھی عمارت کے منصوبے کی منظوری سے قبل یہ یقینی بنائے کہ مختلف اہم اقدامات اٹھائے جائیں۔

مزید برآں ، آگ بجھانے والے محکموں اور شہری دفاع سے عمارتوں کی تعمیر کا کام شروع کرنے سے پہلے ، نان اعتراض سرٹیفکیٹ (این او سی) کی ضرورت پر عمل کیا جائے گا جن کی منظوری دی جائے گی۔

سیکیورٹی بائی قوانین `عملدرآمد کی درخواست کا اعلان ، بلڈنگ کوڈ آف پاکستان کے تحت کیا گیا تھا ، اور اس کی سماعت کے دوران ، جسٹس محمد علی مظہر کی سربراہی میں ایس ایچ سی کے ڈویژن بینچ نے ایس بی سی اے کے ڈائریکٹر جنرل (ڈی جی) سے عدالتی احکامات کی تعمیل کے بارے میں استفسار کیا۔

ہائی کورٹ نے ایس بی سی اے ڈی جی کو حکم دیا ہے کہ وہ کراچی میں بلند و بالا عمارتوں کی تعمیر شروع ہونے سے قبل این او سی جاری کرنے کے قواعد و ضوابط میں ترمیم لانے کے لئے محکمہ شہری دفاع اور چیف فائر آفیسر سے ملاقات کا اہتمام کرے۔

اس سے قبل ہائی کورٹ کے ذریعہ بتایا گیا تھا کہ بلند و بالا عمارتوں ، صنعتوں کے ساتھ ساتھ فیکٹریوں کا معائنہ کرنے کے لئے ضلعی ، سب ضلع اور ڈویژنل سطح پر تین درجے کی ٹاسک فورس تشکیل دی گئی ہے تاکہ یہ یقینی بنایا جاسکے کہ حفاظتی اقدامات کے لئے ضروری اقدامات کو یقینی بنایا جاسکے۔ ان اداروں میں لیا جاتا ہے یا نہیں۔
