SBCA chief directs to implement by-laws

On Wednesday, the implementation of fire safety by-laws under the Building Code of Pakistan has been strictly brought into action by issuing notices to the director-general of The Sindh Building Control Authority (SBCA) and other relevant authorities. This happened due to a petition seeking for their implementation. This step has been taken to prevent damage through fire incidents. As per petitioner Nadeem A Sheikh, due to insufficient fire safety arrangements, two persons had lost their lives and about 13 people got injured in Gulshan-e-Iqbal at a multi-story building.

He stated that the federal government had passed by-laws of the Building Code of Pakistan under Fire Safety Provisions 2016 for preventing harm to lives, and buildings through fire incidents and to prevent such incidents from occurring.; but the implementation of law had still yet to be done by the provincial government. He further stated that before giving approval to multi-story buildings in the city, the building code and fire safety provisions were compulsory. According to law, any construction or modification caused in the building that would conflict with provisions would be considered as desecration of professional engineering works and whoever will take such an action will be strictly punished by law.

The request has been made to the court for giving directions to the Sindh government regarding the implementation of the Building Code of Pakistan, in order to make the multi-story building have proper fire safety measures. The provincial law officer has been inquired in a division bench headed by Justice Mohammad Ali Mazhar, regarding the progress in implementation of the safety laws of building. It has been reported by the assistant commissioner of Karachi that a task force has brought into action to construct a plan, to bring implementation over the safety laws. He further stated that the previous meeting of the task force had been arranged in 2019, but before the court, he failed to produce minutes of the meeting.

It has been ordered by the court, to the provincial law officer, for calling all committee members of the task force and also some officers from the civil defense department to enlighten the court regarding hindrances falling in fire safety by-laws` implementation. A notice has been issued by the court to the Dh of SBCA, according to which he will delegate a focal person to attend the proceedings of the court, taking place on November 3,2020.

بدھ کے روز ، بلڈنگ کوڈ آف پاکستان کے تحت فائر سیفٹی کے ضمنی قوانین کے نفاذ پر سندھ بلڈنگ کنٹرول اتھارٹی (ایس بی سی اے) کے ڈائریکٹر جنرل اور دیگر متعلقہ حکام کو نوٹسز جاری کرتے ہوئے سختی سے کارروائی عمل میں لائی گئی ہے۔ یہ ان کے نفاذ کی درخواست کی وجہ سے ہوا ہے۔ یہ اقدام آگ کے واقعات کے ذریعے ہونے والے نقصان کو روکنے کے لئے اٹھایا گیا ہے۔ درخواست گزار ندیم اے شیخ کے مطابق ، فائر سیفٹی کے ناکافی انتظامات کی وجہ سے ، گلشن اقبال میں ایک کثیر المنزلہ عمارت میں دو افراد اپنی جان سے ہاتھ دھو بیٹھے تھے اور لگ بھگ 13 افراد زخمی ہوگئے تھے۔

نہوں نے بتایا کہ وفاقی حکومت نے فائر سیکیورٹی پروویژنز 2016 کے تحت بلڈنگ کوڈ آف پاکستان کے ضمنی قوانین کو آگ کے واقعات کے ذریعہ جانوں اور عمارتوں کو نقصان پہنچانے سے روکنے اور عمارتوں کو روکنے کے لئے منظور کیا تھا۔ لیکن اس قانون کا نفاذ ابھی تک صوبائی حکومت نے نہیں کیا تھا۔ انہوں نے مزید بتایا کہ شہر میں متعدد منزلہ عمارتوں کو منظوری دینے سے پہلے ، عمارت کے کوڈ اور فائر سیفٹی کی دفعات لازمی تھیں۔ قانون کے مطابق ، عمارت میں جو بھی تعمیراتی یا ترمیم کی گئی ہے جو دفعات سے متصادم ہوگی اسے پیشہ ورانہ انجینئرنگ کے کاموں کی بے حرمتی سمجھا جائے گا اور جو بھی اس طرح کی کاروائی کرے گا اسے قانون کے ذریعہ سخت سزا دی جائے گی۔

عدالت کو بلڈنگ کوڈ آف پاکستان پر عمل درآمد کے سلسلے میں حکومت سندھ کو ہدایات دینے کی استدعا کی گئی ہے ، تاکہ کثیرالمنزلہ عمارت کو آگ سے بچانے کے مناسب اقدامات کیے جائیں۔ صوبائی لاء آفیسر سے جسٹس محمد علی مظہر کی سربراہی میں ڈویژن بینچ میں عمارت کے حفاظتی قوانین کے نفاذ میں پیشرفت کے بارے میں پوچھ گچھ کی گئی ہے۔ اسسٹنٹ کمشنر کراچی کے ذریعہ بتایا گیا ہے کہ حفاظتی قوانین پر عمل درآمد کیلئے ایک ٹاسک فورس نے ایک لائحہ عمل تیار کرنے کے لئے عملی اقدامات کئے ہیں۔ انہوں نے مزید کہا کہ ٹاسک فورس کے سابقہ اجلاس کا اہتمام 2019 میں کیا گیا تھا ، لیکن عدالت کے روبرو ، وہ اجلاس کے چند منٹ پیش کرنے میں ناکام رہے۔

عدالت کے ذریعہ ، صوبائی لاء آفیسر کو ، ٹاسک فورس کے تمام کمیٹی ممبروں اور محکمہ شہری دفاع کے کچھ افسران کو طلب کرنے کے لئے ، جو قوانین پر عمل درآمد سے آگ سے حفاظت میں درپیش رکاوٹوں سے متعلق عدالت کو روشن کرنے کے لئے حکم دیا گیا ہے۔ عدالت نے ایس بی سی اے کے ڈی ایچ کو ایک نوٹس جاری کیا ہے ، جس کے مطابق وہ ایک فوکل پرسن کو عدالت کی کارروائی میں شرکت کے لئے تفویض کرے گا جو 3 نومبر کو ہوگی۔
