Punjab government aims to regularize about 6,000 illegal housing societies

The Punjab government has appointed Justice (R) Azmat Saeed Sheikh as Chairman of the Punjab Commission on Irregular Housing Societies in order to regularize more than 6,000 illegal housing societies in the entire province.

He will be paid a monthly salary equivalent to what he was drawing as a judge of the Supreme Court of Pakistan, according to a source privy to details. Other than the chairman, the commission will comprise four members.

Two each are of town planning and legal background, it was further learnt. A summary moved in this respect named Waseem Ahmed Khan and Aslam Mughal as expert members of urban planning whereas Jawwad ul Hassan and Mubeen Uddin Qazi as legal experts of the commission.

Sheikh previously headed the Broadsheet Commission, which was set up to probe the execution of contracts and payments to Broadsheet LLC in connection with the investigation into offshore assets of politicians and other targets given by NAB to Broadsheet.

However, his main claim to fame was being part of the Panama Papers bench, which had disqualified Prime Minister Nawaz Sharif. While the commission has come into existence, the provincial government is still working on the law in order to remove some anomalies.

On the direction of the federal government, the Punjab government haphazardly promulgated “The Punjab Commission for Regularization of Irregular Housing Schemes Ordinance 2021” in April this year in order to regularize housing schemes but the entire process was carried out without proper consultation; even the relevant departments were not taken into confidence.

The ordinance was drafted in consultation with a key constitutional office-bearer of Punjab so as to avert any legal crisis should the legislation be challenged in any court of law.

پنجاب حکومت نے پورے صوبے میں 6 ہزار سے زائد غیر قانونی ہاؤسنگ سوسائٹیوں کو ریگولرائز کرنے کے لیے جسٹس (ر) عظمت سعید شیخ کو پنجاب کمیشن برائے غیر قانونی ہاؤسنگ سوسائٹیز کا چیئرمین مقرر کر دیا ہے۔

تفصیلات سے باخبر ذرائع کے مطابق، انہیں سپریم کورٹ آف پاکستان کے جج کے طور پر ملنے والی تنخواہ کے برابر ماہانہ تنخواہ دی جائے گی۔ چیئرمین کے علاوہ کمیشن چار ارکان پر مشتمل ہوگا۔

مزید معلوم ہوا کہ دو دو ٹاؤن پلاننگ اور قانونی پس منظر کے ہیں۔ اس سلسلے میں ایک سمری پیش کی گئی جس میں وسیم احمد خان اور اسلم مغل کو شہری منصوبہ بندی کے ماہر ارکان جبکہ جواد الحسن اور مبین الدین قاضی کو کمیشن کے قانونی ماہرین کے طور پر نامزد کیا گیا۔

شیخ اس سے قبل براڈ شیٹ کمیشن کی سربراہی کر رہے تھے، جو براڈ شیٹ ایل ایل سی کو معاہدے اور ادائیگیوں کی تحقیقات کے لیے قائم کیا گیا تھا جس میں سیاستدانوں کے آف شور اثاثوں کی تحقیقات اور نیب کی جانب سے براڈ شیٹ کو دیے گئے دیگر اہداف تھے۔

تاہم، ان کی شہرت کا بنیادی دعویٰ پاناما پیپرز بنچ کا حصہ تھا، جس نے وزیراعظم نواز شریف کو نااہل قرار دیا تھا۔ کمیشن کے وجود میں آنے کے باوجود صوبائی حکومت کچھ بے ضابطگیوں کو دور کرنے کے لیے قانون پر کام کر رہی ہے۔

وفاقی حکومت کی ہدایت پر پنجاب حکومت نے ہاؤسنگ سکیموں کو ریگولرائز کرنے کے لیے رواں سال اپریل میں ’’پنجاب کمیشن فار ریگولرائزیشن آف ریگولر ہاؤسنگ سکیمز آرڈیننس 2021‘‘ جاری کیا لیکن یہ سارا عمل مناسب مشاورت کے بغیر کیا گیا۔ متعلقہ محکموں کو بھی اعتماد میں نہیں لیا گیا۔

آرڈیننس کا مسودہ پنجاب کے ایک اہم آئینی عہدیدار کی مشاورت سے تیار کیا گیا تھا تاکہ کسی بھی قانونی بحران کو روکنے کے لیے قانون سازی کو کسی بھی عدالت میں چیلنج کیا جائے۔
