MCL demands control of Lahore division areas from LDA

The Metropolitan Corporation of Lahore (MCL) has asked the Local Government and Community Development Department (LGCDD) to help get back its building and land use controlled area from the Lahore Development Authority (LDA) after amendments to the LDA Act, 1975.

In a letter, the MCL while giving reference of the LGCD department’s letter of April 23, 2021, titled “Curtailment of the Jurisdiction of the LDA with Respect to Land-Use and Housing Schemes Viz-A-Viz Nankana Sahib, Sheikhupura and Kasur” states the letter was issued in pursuance of the amendments made to the LDA Act, 1975, vide the LDA (Amendment) Ordinance 2021 (SVIII of 2021), whereby the metropolitan area of Lahore division has been amended and substituted with the words “Metropolitan area of Lahore in sections 1, 2, 3, 4, 5, & 6 of the LDA Act, 1975. These amendments were principally made for ease of doing business in construction industries.

Earlier, through the amended LDA Act, 1975 in 2013, the metropolitan area of Lahore was extended to the entire Lahore division, and the LDA was given land-use control and private housing schemes.

Now, the MCL explains, that with instant amendments to the LDA Act, 1975, the jurisdiction of the LDA has been brought back to the pre-2013 era. It also mentions that the City District Government of Lahore was previously collecting more than Rs2 billion per annum on account of the conversion of the land-use fee before the transfer of land-use control to the LDA.

ایک خط میں ، ایم سی ایل نے LGCD ڈیپارٹمنٹ کے 23 اپریل 2021 کے خط کا حوالہ دیتے ہوئے ، جس کا عنوان ہے "زمین کے استعمال اور ہاؤسنگ سکیموں کے احترام کے ساتھ ایل ڈی اے کے دائرہ اختیار کا خاتمہ ویز اے وز ننکانہ صاحب ، شیخوپورہ اور قصور" ایل ڈی اے ایکٹ ، 1975 میں کی گئی ترامیم کے مطابق ایل ڈی اے (ترمیمی) آرڈیننس 2021 (2021 کا ایس وی آئی آئی آئی) کے تحت یہ خط جاری کیا گیا ، جس کے تحت لاہور ڈویژن کے میٹروپولیٹن ایریا میں ترمیم کی گئی ہے اور اس کے متبادل الفاظ "میٹروپولیٹن ایریا" ایل ڈی اے ایکٹ 1975 کے سیکشن 1 ، 2 ، 3 ، 4 ، 5 ، اور 6 میں لاہور کی۔

اس سے قبل ، 2013 میں ترمیم شدہ ایل ڈی اے ایکٹ ، 1975 کے ذریعے ، لاہور کا میٹروپولیٹن علاقہ پورے لاہور ڈویژن تک بڑھا دیا گیا تھا اور ایل ڈی اے کو لینڈ یوز کنٹرول اور پرائیویٹ ہاؤسنگ سکیمیں دی گئی تھیں۔

اب ، ایم سی ایل وضاحت کرتا ہے ، کہ ایل ڈی اے ایکٹ ، 1975 میں فوری ترامیم ، ایل ڈی اے کے دائرہ اختیار کو 2013 سے پہلے کے دور میں واپس لایا گیا ہے۔ اس میں یہ بھی بتایا گیا ہے کہ اس وقت لاہور کی سٹی ڈسٹرکٹ گورنمنٹ ایل ڈی اے کو لینڈ یوز کنٹرول کو منتقل کرنے سے پہلے لینڈ یوز فیس کو تبدیل کرنے کی وجہ سے سالانہ 2 ارب روپے سے زائد وصول کر رہی تھی۔
