MCI bans commercials of housing projects having no valid NOC

According to the news sources, the administration of Metropolitan Corporation Islamabad (MCI) has banned with immediate effect all sorts of advertisements as steamers, boards, banners, and others regarding housing societies and projects in the capital city limits which do not reflect valid NOC issued by the Capital Development Authority (CDA).

A notification to this effect was issued by the administrator MCI Muhammad Hamza Shafqaat on Tuesday. According to the news sources, Islamabad Capital Territory (ICT) administration had banned any sort of publication regarding the launching of any housing scheme in a manner of not following the law.

According to the order issued on November 2021 by District, Magistrate Islamabad said that it was brought to the notice of the District Justice that some housing societies, trusts, limited companies, groups, etc. are operating in the territory of Islamabad in a manner not warranted by the law relating thereto.

According to the notice, “Such societies, companies, trusts, groups, etc. allure the public at large by advertising the launching of housing schemes in newspapers, magazines, brochures and booklets and even through local sale,” It further addresses such societies, trusts, companies, etc. invite association either above the land available to them or without having any land at all.

This practice results in misuse, fraud, forgery, disputes, crimes, law and order problems and massive litigation in courts,” this order was issued under section 144 of the CrPC.

The district administration banned any sort of publication and advertisement regarding the sale of plots, inviting applications to deposit membership fee or cost of plots in such housing schemes, without observing all legal and codal procedures as envisaged in the laws applicable thereto unless prior permission is obtained from the office of the district justice. This order shall remain in force for two months. The ICT administration believes that theoretical transactions also emerge out of the situation which risks the interest of the general public and deprives it of its hard-earned money, thus creating anxiety in the society.  

According to the news sources, Last week, the capital administration had also launched a property verification center to deal with property-related fraud in the city. Deputy Commissioner (DC) Muhammad Hamza Shafqaat inaugurated the Property Verification Centre (PVC) at Facilitation Centre in the DC Office.

ذرائع کے مطابق میٹرو پولیٹن کارپوریشن اسلام آباد (ایم سی آئی) کی انتظامیہ نے دارالحکومت کی حدود میں ہاؤسنگ سوسائٹیز اور پراجیکٹس کے حوالے سے ہر قسم کے سٹیمر، بورڈز، بینرز اور دیگر اشتہارات پر فوری طور پر پابندی عائد کر دی ہے جو کہ جاری کردہکیپٹل ڈویلپمنٹ اتھارٹی (سی ڈی اے) کے ذریعے درست این او سی کی عکاسی نہیں کرتے۔ ۔
اس سلسلے میں ایک نوٹیفکیشن منگل کو ایڈمنسٹریٹر ایم سی آئی محمد حمزہ شفقات نے جاری کیا۔ نیوز ذرائع کے مطابق اسلام آباد کیپیٹل ٹیریٹری (آئی سی ٹی) انتظامیہ نے قانون پر عمل نہ کرتے ہوئے کسی بھی ہاؤسنگ اسکیم کے اجراء کے حوالے سے کسی بھی قسم کی اشاعت پر پابندی عائد کر دی تھی۔
ڈسٹرکٹ مجسٹریٹ اسلام آباد کی طرف سے نومبر 2021 کو جاری کردہ حکم نامے کے مطابق ڈسٹرکٹ جسٹس کے نوٹس میں یہ بات لائی گئی کہ اسلام آباد کی حدود میں کچھ ہاؤسنگ سوسائٹیز، ٹرسٹ، لمیٹڈ کمپنیاں، گروپ وغیرہ کام کر رہے ہیں۔ اس سے متعلق قانون کے ذریعہ تصدیق شدہ۔
نوٹس کے مطابق، "اس طرح کی سوسائٹیاں، کمپنیاں، ٹرسٹ، گروپ وغیرہ اخبارات، رسالوں، بروشرز اور بکلیٹس میں ہاؤسنگ سکیموں کے اجراء کا اشتہار دے کر اور یہاں تک کہ مقامی فروخت کے ذریعے بھی عوام کو راغب کرتے ہیں،" یہ مزید ایسی سوسائٹیوں سے خطاب کرتا ہے، ٹرسٹ، کمپنیاں وغیرہ یا تو ان کے پاس دستیاب زمین سے اوپر یا بغیر کسی زمین کے انجمن کو مدعو کرتے ہیں۔
اس عمل کے نتیجے میں غلط استعمال، دھوکہ دہی، جعلسازی، تنازعات، جرائم، امن و امان کے مسائل اور عدالتوں میں بڑے پیمانے پر قانونی چارہ جوئی ہوتی ہے۔" یہ حکم سی آر پی سی کی دفعہ 144 کے تحت جاری کیا گیا تھا۔
ضلعی انتظامیہ نے پلاٹوں کی فروخت سے متعلق کسی بھی قسم کی اشاعت اور اشتہارات پر پابندی عائد کر دی ہے، ایسی ہاؤسنگ سکیموں میں ممبر شپ فیس یا پلاٹوں کی قیمت جمع کروانے کے لیے درخواستوں کو مدعو کرنا، تمام قانونی اور ضابطہ کار طریقہ کار کا مشاہدہ کیے بغیر، جب تک کہ پیشگی اجازت نہ لی جائے۔ ضلعی انصاف کے دفتر سے یہ حکم دو ماہ تک نافذ العمل رہے گا۔ آئی سی ٹی انتظامیہ کا خیال ہے کہ نظریاتی لین دین بھی اس صورت حال سے نکلتا ہے جس سے عام لوگوں کے مفاد کو خطرہ لاحق ہوتا ہے اور وہ اس کی محنت کی کمائی سے محروم ہو جاتے ہیں، اس طرح معاشرے میں بے چینی پیدا ہوتی ہے۔
خبر رساں ذرائع کے مطابق گزشتہ ہفتے دارالحکومت کی انتظامیہ نے شہر میں جائیداد سے متعلق فراڈ سے نمٹنے کے لیے پراپرٹی کی تصدیق کا مرکز بھی شروع کیا تھا۔ ڈپٹی کمشنر (ڈی سی) محمد حمزہ شفقات نے ڈی سی آفس میں سہولت سنٹر میں پراپرٹی ویری فکیشن سنٹر (پی وی سی) کا افتتاح کیا۔
