Legality Of Portions To Be Sold To Residential Units Questioned By The SHC

The issue was raised through a petition which was filed against the construction of additional floors in residential buildings in the Sindhi Muslim society. The petitioner claimed that he had bought the first two floors of a residential building however the private builder was building two more floors on the building, which was a violation of the law.

The legal status of a portion being sub-leased was questioned by a division bench of the SHC. This further raised questions upon the observation of one residential plot accommodating several families. It was revealed that sub-registrar offices were also allowing sub-leases on residential areas in violation of the law.

یہ معاملہ ایک درخواست کے ذریعے اٹھایا گیا تھا جو سندھی مسلم سوسائٹی میں رہائشی عمارتوں میں اضافی منزلوں کی تعمیر کے خلاف دائر کی گئی تھی۔ درخواست گزار نے دعویٰ کیا کہ اس نے رہائشی عمارت کی پہلی دو منزلیں خریدی ہیں تاہم پرائیویٹ بلڈر عمارت پر مزید دو منزلیں بنا رہا ہے جو کہ قانون کی خلاف ورزی ہے۔
ذیلی لیز پر دیئے گئے حصے کی قانونی حیثیت پر سندھ ہائی کورٹ کے ڈویژن بنچ نے سوال اٹھایا۔ اس سے کئی خاندانوں کے رہنے والے ایک رہائشی پلاٹ کے مشاہدے پر مزید سوالات اٹھے۔ انکشاف ہوا کہ سب رجسٹرار دفاتر بھی قانون کی خلاف ورزی کرتے ہوئے رہائشی علاقوں پر سب لیز کی اجازت دے رہے ہیں۔
