LDA files cases against 241 illegal housing schemes in Lahore

A petition against the establishment of 557 housing societies on greenbelts was heard by a single-judge bench including Lahore High Court Chief Justice Muhammad Qasim Khan.

Chief Justice gave his remarks about illegal housing schemes saying that the housing regulator was only completing formalities for the court.

The petitioner claimed that LDA has failed to act against illegal housing schemes despite the court orders and said:

“The cases are in courts since 2015 but the LDA has failed to recover even an inch of the encroached land.”

“A better environment is the constitutional right of every citizen, if the LDA director general cannot assist the court, I will constitute a commission,” the judge said.

“If you can act against the illegal housing schemes, inform the court tomorrow (Wednesday), otherwise the court will constitute a commission,” the court said.

لاہور: لاہور ڈویلپمنٹ اتھارٹی (ایل ڈی اے) نے منگل کو گرین بیلٹس کی خلاف ورزی میں جوابدہ قرار دی جانے والی 241 نجی ہاؤسنگ سوسائٹیوں کے خلاف درج پولیس مقدمات کے بارے میں لاہور ہائی کورٹ کو آگاہ کیا۔ گرین بیلٹس پر 557 ہاؤسنگ سوسائٹیوں کے قیام کے خلاف درخواست کی سماعت ہائی کورٹ کے چیف جسٹس محمد قاسم خان سمیت سنگل جج بینچ نے کی۔

چیف جسٹس نے اپنے ریمارکس دیتے ہوئے کہا کہ ہاؤسنگ ریگولیٹر صرف عدالت کے لئے رسمی کارروائیوں کو مکمل کررہا ہے۔

درخواست گزار نے دعوی کیا کہ ایل ڈی اے عدالتی احکامات کے باوجود اسکیموں کے خلاف کارروائی کرنے میں ناکام رہی ہے اور کہا:
"یہ مقدمات 2015 سے عدالتوں میں ہیں لیکن ایل ڈی اے تجاوزات کا ایک انچ بھی اراضی حاصل کرنے میں ناکام رہا ہے۔"
جج نے کہا ، "بہتر ماحول ہر شہری کا آئینی حق ہے ، اگر ایل ڈی اے کے ڈائریکٹر جنرل عدالت کی مدد نہیں کرسکتے ہیں تو میں ایک کمیشن تشکیل دوں گا۔"
عدالت نے کہا ، "اگر آپ معاشروں کے خلاف کارروائی کرسکتے ہیں تو کل (بدھ کو) عدالت کو آگاہ کریں ، ورنہ عدالت ایک کمیشن تشکیل دے گی۔"
