Lahore High Court asks for the records of its land changes with regard to DHA

Lahore High Court Chief Justice Muhammad Qasim Khan on Thursday directed the registrar's office to present a complete record of a 2016 summary regarding a mutation of a piece of land measuring 50 kanals owned by the court in favor of the Defence Housing Authority (DHA).

The chief justice observed that a letter of the registrar circulated on social media about the land transfer had no legal value.

He said the land of the LHC could not be given to anyone through an order of the chief justice but it required a decision by the seven-member administration committee.

It merits mentioning that at a previous hearing, Chief Justice Khan had lashed out at the DHA for illegally occupying the lands of the people and lamented that the authority even took over land owned by the LHC.

During Thursday’s hearing, Chief Justice Khan observed that the FIA took no action against the malicious campaign against the judiciary as an institution.

He further feared that there would be a law of the jungle if disrespect of the institutions continued.

“The people would prefer picking up guns instead of approaching courts for justice once their trust in the judicial system is shaken,” the chief justice remarked.

A counsel of the DHA sought time to file a detailed answer on the matter, and the chief justice delayed further hearing till next week.

لاہور ہائیکورٹ کے چیف جسٹس محمد قاسم خان نے جمعرات کو رجسٹرار آفس کو ہدایت کی کہ وہ ڈیفنس ہاؤسنگ اتھارٹی (ڈی ایچ اے) کے حق میں عدالت کی ملکیت 50 کنال اراضی کے ٹکڑے میں تبدیلی کے سلسلے میں 2016 کے سمری کا مکمل ریکارڈ پیش کریں۔

چیف جسٹس نے دیکھا کہ اراضی کی منتقلی کے بارے میں سوشل میڈیا پر رجسٹرار کے ایک خط کی کوئی قانونی قیمت نہیں ہے۔

انہوں نے کہا کہ لاہور ہائیکورٹ کی اراضی چیف جسٹس کے حکم کے ذریعے کسی کو نہیں دی جاسکتی ہے لیکن اس کے لئے سات رکنی انتظامیہ کمیٹی کے فیصلے کی ضرورت ہے۔

یہ بات قابل ذکر ہے کہ گذشتہ سماعت پر چیف جسٹس خان نے لوگوں کی زمینوں پر غیرقانونی طور پر قبضہ کرنے پر ڈی ایچ اے پر حملہ کیا تھا اور افسوس کا اظہار کیا تھا کہ اتھارٹی نے یہاں تک کہ ایل ایچ سی کی ملکیت والی زمین بھی اپنے قبضہ کرلی ہے۔

جمعرات کی سماعت کے دوران ، چیف جسٹس خان نے دیکھا کہ ایف آئی اے نے عدلیہ کے خلاف بطور ادارہ بدنیتی پر مبنی مہم کے خلاف کوئی کارروائی نہیں کی۔

انہوں نے مزید خدشہ ظاہر کیا کہ اگر اداروں کی بے حرمتی جاری رہی تو جنگل کا کوئی قانون ہوگا۔

چیف جسٹس نے ریمارکس دیے ، "عدالتی نظام پر اعتماد ہل جانے پر عوام انصاف کے لئے عدالتوں سے رجوع کرنے کے بجائے بندوق اٹھانا ترجیح دیں گے۔"

ڈی ایچ اے کے ایک وکیل نے معاملے پر تفصیلی جواب داخل کرنے کے لئے وقت مانگا ، اور چیف جسٹس نے مزید سماعت اگلے ہفتے تک ملتوی کردی۔
