KMC inquires cancellation of property leases on Karachi drains

The Sindh High Court (SHC) directed the Karachi Metropolitan Corporation’s (KMC) counsel to file comments mentioning if the Supreme Court has issued an order for cancellation of the 99-year leases of the properties issued under the Katchi Abadis Act or by the Karachi Development Authority (KDA).

An SHC division bench was hearing a petition against the demolition of leased houses during an operation underway across Karachi to clear the city’s stormwater drains of all encroachments.

Headed by Justice Syed Hasan Azhar Rizvi, the bench asked the KMC’s law officers about the SC’s orders on the cancellation of the leases issued under the Katchi Abadis Act or by the KDA to the properties built on the drains.

The KMC’s counsel and the provincial law officer said they have no knowledge of any order being issued to cancel such leases, and they sought time to file comments with regard to the SC’s orders on the matter.

The counsel of the families affected by the operation said the KMC has also filed an application to the SC seeking appropriate orders in respect of the proceedings pending before an anti-encroachment tribunal.

He said the KMC has involved the SC to remove encroachments, not the properties with 99-year leases.

ایس ایچ سی ڈویژن بنچ کراچی بھر میں آپریشن کے دوران لیز مکانات مسمار کرنے کے خلاف درخواست کی سماعت کررہا تھا تاکہ شہر کے طوفان آلود پانیوں کو تمام تجاوزات سے پاک کیا جاسکے۔

جسٹس سید حسن اظہر رضوی کی سربراہی میں ، بنچ نے کے ایم س�� کے افسران سے کچی آبادی ایکٹ کے تحت جاری ہونے والے لیزوں کی منسوخی یا نالیوں میں بنائی گئی املاک کو کے ڈی اے کے ذریعہ ایس سی کے احکامات کے بارے میں پوچھا۔

کے ایم سی کے وکیل ، اور صوبائی لاء آفیسر نے کہا کہ انہیں اس طرح کے لیز منسوخ کرنے کے لئے جاری کیے جانے والے کسی آرڈر کا کوئی علم نہیں ہے ، اور انہوں نے معاملے پر سپریم کورٹ کے احکامات کے بارے میں تبصرے درج کرنے کے لئے وقت مانگا ہے۔

آپریشن سے متاثرہ خاندانوں کے وکیل نے بتایا کہ کے ایم سی نے انسداد تجاوزات ٹریبونل کے سامنے زیر التواء کارروائی کے سلسلے میں مناسب احکامات طلب کرنے کے لئے ایس سی کو درخواست بھی دائر کردی ہے۔

انہوں نے کہا کہ کے ایم سی نے تجاوزات ہٹانے کے لئے ایس سی کو شامل کیا ہے ، 99 سالہ لیز پر مشتمل پراپرٹیز نہیں۔
