IWMB to move court against Khayaban-e-Margallah project

According to the news sources, the capital development authority is constructing a portion of Margalla Road from Sangjani to D-12 and has already completed half of the work. However, on Dec 16, Pak-EPA issued a protection order, directing the CDA to stop the work as it was being carried out without an environmental impact assessment (EIA).

Now Islamabad wildlife management board decided that they would file an application in court against the construction of Khayaban-e-Margallah in sheer violation of the environmental laws.

According to the news sources, IWMB chairperson Rina Saeed Khan said, “An environmental protection order was given out a few days ago to stop construction on this project. Yet the machines continue to cut into protected Margallah Hills National Park (MHNP). So, we have decided to move court against it.

 “A chunk of the national park is being destroyed by constructing a highway and intention to build a residential sector in C-15 and C-14 on the protected land.” She added

While talking to the media she highlighted the challenges being faced by the IWMB during a panel discussion on COP26 Ecosystem Restoration a few days back.  she stated that the IWMB is the legal custodian of the national park but there were numerous problems including encroachment, forest fires, and littering. She also added that it is extremely difficult to implement policies regarding the protection of natural ecosystems in protected MHNP.

According to the news sources, The Pak-EPA has also been ordered to immediately stop work on the Khayaban-e-Margallah project and directed to follow environmental laws to avoid any legal action.

نیوز ذرائع کے مطابق کیپیٹل ڈویلپمنٹ اتھارٹی سنگجانی سے ڈی 12 تک مارگلہ روڈ کا ایک حصہ تعمیر کر رہی ہے اور اس کا نصف کام مکمل کر لیا گیا ہے۔ تاہم، 16 دسمبر کو پاک-ای پی اے نے ایک پروٹیکشن آرڈر جاری کیا، جس میں سی ڈی اے کو کام روکنے کی ہدایت کی گئی کیونکہ یہ کام ماحولیاتی اثرات کی تشخیص (ای آئ اے) کے بغیر کیا جا رہا تھا۔
اب اسلام آباد وائلڈ لائف مینجمنٹ بورڈ نے فیصلہ کیا ہے کہ وہ ماحولیاتی قوانین کی سراسر خلاف ورزی کرتے ہوئے خیابان مارگلہ کی تعمیر کے خلاف عدالت میں درخواست دائر کریں گے۔
نیوز ذرائع کے مطابق، (آئی ڈبلیو ایم بی) کی چیئرپرسن رینا سعید خان نے کہا، "اس منصوبے پر تعمیرات روکنے کے لیے چند روز قبل ماحولیاتی تحفظ کا آرڈر دیا گیا تھا۔ پھر بھی مشینیں مارگلہ ہلز نیشنل پارک (ایم ایچ این پی) میں کام کرتی رہیں۔ اس لیے ہم نے اس کے خلاف عدالت جانے کا فیصلہ کیا ہے۔
"نیشنل پارک کا ایک حصہ ہائی وے بنا کر تباہ کیا جا رہا ہے اور محفوظ زمین پر سی-15 اور سی-14 میں رہائشی سیکٹر بنانے کا ارادہ ہے۔" اس نے مزید کہا
میڈیا سے گفتگو کرتے ہوئے انہوں نے چند روز قبل (سی او پی26) ایکو سسٹم کی بحالی پر ایک پینل ڈسکشن کے دوران (آئی ڈبلیو ایم بی) کو درپیش چیلنجز پر روشنی ڈالی۔ انہوں نے کہا کہ آئی ڈبلیو ایم بی نیشنل پارک کا قانونی محافظ ہے لیکن تجاوزات، جنگل کی آگ اور کوڑا کرکٹ سمیت متعدد مسائل تھے۔ انہوں نے یہ بھی کہا کہ محفوظ (ایم ایچ این پی) میں قدرتی ماحولیاتی نظام کے تحفظ کے حوالے سے پالیسیوں کو نافذ کرنا انتہائی مشکل ہے۔
نیوز ذرائع کے مطابق پاک ای پی اے کو خیابان مارگلہ پراجیکٹ پر کام فوری طور پر روکنے کا بھی حکم دیا گیا ہے اور کسی بھی قانونی کارروائی سے بچنے کے لیے ماحولیاتی قوانین پر عمل کرنے کی ہدایت کی گئی ہے۔
