Issuing tenders without waiting for SC verdict on LG system malafide: LHC

The Lahore High Court observed that various tenders of development works are issued by the administrators without waiting for the detailed judgment of the Supreme Court about the restoration of the LG system showed mala fide on part of the provincial government.

Justice Ayesha A Malik was hearing multiple petitions against tenders issued by the administrators in different districts. Additional Advocate General (AAG) Akhtar Javed opposed the petitions and argued that the provincial government had the power to hold auctions.

He said the auctions being held by the government were in conformity with the apex court’s judgment. Justice Malik expressed dissatisfaction over the law officer’s stance and observed that the provincial government did not wait for the detailed judgment of the SC in the matter and went on to issue tenders.

“This shows the mala fide of the government,” she added. The judge adjourned further hearing till July 16 and also extended the stay against the tenders. The petitioners argued that after the Supreme Court's judgment and restoration of dissolved local governments, the administrators ceased to hold office.

They said the administrators could not put the shops/properties on auction or enhance the rent, which only the elected head of LGs and the council could do. They asked the court to set aside the impugned auction for being illegal.

The Lahore High Court on Monday issued a notice to the Punjab government on a set of petitions seeking implementation of a Supreme Court’s judgment about restoration of local governments in the province.

لاہور ہائیکورٹ نے مشاہدہ کیا کہ ایل جی سسٹم کی بحالی کے بارے میں سپریم کورٹ کے تفصیلی فیصلے کا انتظار کیے بغیر ایڈمنسٹریٹرز کی جانب سے ترقیاتی کاموں کے مختلف ٹینڈرز جاری کردیئے جاتے ہیں جس سے صوبائی حکومت کی جانب سے عدم استحکام ظاہر کیا گیا۔

جسٹس عائشہ اے ملک مختلف اضلاع میں منتظمین کی جانب سے جاری کردہ ٹینڈروں کے خلاف متعدد درخواستوں کی سماعت کر رہی تھیں۔ ایڈیشنل ایڈووکیٹ جنرل (اے اے جی) اختر جاوید نے ان درخواستوں کی مخالفت کی ، اور کہا کہ صوبائی حکومت کو نیلامی کرنے کا اختیار ہے۔

انہوں نے کہا کہ حکومت کی طرف سے جو نیلامی کی جارہی ہے وہ عدالت عظمی کے فیصلے کے مطابق ہے۔ جسٹس ملک نے لاء آفیسر کے اس موقف پر عدم اطمینان کا اظہار کیا اور کہا کہ صوبائی حکومت نے معاملے میں سپریم کورٹ کے تفصیلی فیصلے کا انتظار نہیں کیا اور ٹینڈر جاری کرنے پر کام کیا۔

انہوں نے مزید کہا ، "اس سے حکومت کی مایوسی ظاہر ہوتی ہے۔ جج نے مزید سماعت 16 جولائی تک ملتوی کردی اور ٹینڈروں کے خلاف روکنے میں بھی توسیع کردی۔ درخواست گزاروں کا موقف تھا کہ سپریم کورٹ کے فیصلے اور تحلیل مقامی حکومتوں کی بحالی کے بعد منتظمین نے عہدہ چھوڑنا چھوڑ دیا۔

ان کا کہنا تھا کہ منتظم دکانیں / جائیدادیں نیلامی میں نہیں ڈال سکتے اور نہ ہی کرایہ میں اضافہ کرسکتے ہیں ، جو ایل جی اور کونسل کے صرف منتخب سربراہ ہی کرسکتے ہیں۔ انہوں نے عدالت سے مطالبہ کیا کہ غیر قانونی ہونے کی وجہ سے ناجائز نیلامی کو ایک طرف رکھا جائے۔

لاہور ہائیکورٹ نے پیر کو پنجاب حکومت کو صوبے میں بلدیاتی حکومتوں کی بحالی سے متعلق سپریم کورٹ کے فیصلے پر عمل درآمد کی درخواستوں کے ایک سیٹ پر نوٹس جاری کیا۔
