IHC seeks master plan of federal capital from cabinet for Local housing societies

The Islamabad High Court (IHC) sought the status of the master plan of federal capital from the cabinet in a case of the local housing societies against the FIA’s call-up notice.

IHC Chief Justice Athar Minallah heard the case against the call-up notice of the Federal Investigation Agency (FIA) to the housing societies.

At the outset of the hearing, the chief justice remarked that there was also a case against permission to the Intelligence Bureau (IB) for acquiring land for the school. How the land acquisition collector had issued the notice in this regard without completing the legal formalities, the court said.

The court observed that only the Capital Development Authority (CDA) was authorized for the acquisition of land and it could acquire the land only under the master plan of the federal capital.

The government had set up the Federal Government Employee Housing Authority (FGEHA) but its functioning was different.

The deputy attorney general said he would inform the court after getting information from the government regarding the status of the master plan.

After this, the hearing of the case was adjourned for one month. It may be mentioned here that the Federal Investigation Agency (FIA) had served notices to the housing society regarding illegal commercialization, illegal extension, and others.

اسلام آباد ہائی کورٹ نے ایف آئی اے کے کال اپ نوٹس کے خلاف مقامی ہاؤسنگ سوسائٹیز کے معاملے میں کابینہ سے وفاقی دارالحکومت کے ماسٹر پلان مانگا۔

آئی ایچ سی کے چیف جسٹس اطہر من اللہ نے وفاقی تحقیقاتی ایجنسی (ایف آئی اے) کے ہاؤسنگ سوسائٹیز کو کال اپ نوٹس کے خلاف کیس کی سماعت کی۔

سماعت کے آغاز پر چیف جسٹس نے ریمارکس دیے کہ سکول کے لیے زمین کے حصول کے لیے انٹیلی جنس بیورو (آئی بی) کی اجازت کے خلاف بھی ایک کیس ہے۔ عدالت نے کہا کہ کس طرح اراضی کے حصول کے کلکٹر نے اس سلسلے میں قانونی ضابطے مکمل کیے بغیر نوٹس جاری کیا تھا۔

عدالت نے مشاہدہ کیا کہ زمین کے حصول کے لیے صرف کیپیٹل ڈیولپمنٹ اتھارٹی (سی ڈی اے) مجاز ہے اور وہ صرف وفاقی دارالحکومت کے ماسٹر پلان کے تحت زمین حاصل کر سکتی ہے۔

حکومت نے فیڈرل گورنمنٹ ایمپلائی ہاؤسنگ اتھارٹی قائم کی تھی لیکن اس کا کام مختلف تھا۔

ڈپٹی اٹارنی جنرل نے کہا کہ وہ حکومت سے ماسٹر پلان کی حیثیت کے بارے میں معلومات حاصل کرنے کے بعد عدالت کو آگاہ کریں گے۔

اس کے بعد کیس کی سماعت ایک ماہ کے لیے ملتوی کر دی گئی۔ واضح رہے کہ فیڈرل انویسٹی گیشن ایجنسی (ایف آئی اے) نے ہاؤسنگ سوسائٹی کو غیر قانونی تجارتی بنانے ، غیر قانونی توسیع اور دیگر کے حوالے سے نوٹس جاری کیے تھے۔
