IHC orders demolition of navy’s farmhouses, sailing club in capital

According to the news sources, the High court issued directions to initiate criminal proceedings against former naval chief Zafar Mehmud Abbasi and other officials for approving the illegal constructions.

According to the reports, in a 45-page judgment, Islamabad high court Chief Justice Athar Minallah ordered the Capital Development Authority to take over the naval farmhouses, saying that the navy had “trespassed on the land situated on the embankment of Rawal Lake, and that too in a protected national park area”.

It noted that the club building “shall not be regularized in any manner for having been illegally constructed in an ecologically sensitive area in violation of the mandatory provisions.”

Islamabad High court also declared that the occupation of the land was “illegal, without lawful authority and jurisdiction”.

The navy has been ordered to cease all its activities on Rawal Lake and hand over the land to the Small Dams Organisation, while the court ordered the Islamabad Wildlife Management Board to restore the natural habitat in the lake’s surroundings.

نیوز ذرائع کے مطابق ہائی کورٹ نے غیر قانونی تعمیرات کی منظوری دینے پر سابق نیول چیف ظفر محمود عباسی اور دیگر افسران کے خلاف فوجداری کارروائی شروع کرنے کی ہدایت جاری کردی۔
رپورٹس کے مطابق 45 صفحات پر مشتمل فیصلے میں اسلام آباد ہائی کورٹ کے چیف جسٹس اطہر من اللہ نے کیپٹل ڈیولپمنٹ اتھارٹی کو بحریہ کے فارم ہاؤسز کو قبضے میں لینے کا حکم دیتے ہوئے کہا کہ بحریہ نے "راول جھیل کے پشتے پر واقع زمین پر تجاوزات کی ہیں، اور وہ بھی ایک محفوظ قومی پارک کے علاقے میں"۔
اس نے نوٹ کیا کہ کلب کی عمارت کو "کسی بھی طرح سے ریگولرائز نہیں کیا جائے گا کیونکہ لازمی دفعات کی خلاف ورزی کرتے ہوئے ماحولیاتی طور پر حساس علاقے میں غیر قانونی طور پر تعمیر کیا گیا ہے۔"
اسلام آباد ہائی کورٹ نے یہ بھی قرار دیا کہ زمین پر قبضہ "غیر قانونی، قانونی اختیار اور دائرہ اختیار کے بغیر" تھا۔
بحریہ کو راول جھیل پر تمام سرگرمیاں بند کرنے اور زمین سمال ڈیمز آرگنائزیشن کے حوالے کرنے کا حکم دیا گیا ہے جب کہ عدالت نے اسلام آباد وائلڈ لائف مینجمنٹ بورڈ کو جھیل کے گردونواح میں قدرتی رہائش بحال کرنے کا حکم دے دیا۔
