High court orders SBCA to demolish illegal construction in Agra Taj Colony

According to the news sources the direction came on a petition of Ashfaq Ahmed against the raising of illegal construction in the Agra Taj Colony. The petitioner’s counsel, Aisha Soomro, submitted that a private builder was raising an illegal construction on plot 232 in Agra Taj Colony, which occupies 96 square yards.

During the petition, she said that the private builder had constructed a multi-story building on a small plot without the endorsement of the SBCA, and residents of the area were facing hardship due to the construction of unauthorized portions.

“A seven-story building built in the area where buildings above ground plus two are not allowed,” Justice Rajput remarked. “According to the petitioner, the builder even not have permission to built ground plus two structures,” the court observed.

“How it is possible to build without support from the SBCA officials,” the bench posed the question.

The court ordered to seal the illegal structure and action against the builder under the criminal law within a week. The bench also ordered action against officials of the building control authority.

نیوز ذرائع کے مطابق یہ ہدایت آگرہ تاج کالونی میں غیر قانونی تعمیرات کے خلاف اشفاق احمد کی درخواست پر سامنے آئی ہے۔ درخواست گزار کی وکیل عائشہ سومرو نے موقف اختیار کیا کہ آگرہ تاج کالونی میں ایک پرائیویٹ بلڈر 96 مربع گز کے پلاٹ 232 پر غیر قانونی تعمیرات کر رہا ہے۔
درخواست کے دوران انہوں نے کہا کہ پرائیویٹ بلڈر نے ایس بی سی اے کی توثیق کے بغیر ایک چھوٹے سے پلاٹ پر کثیر المنزلہ عمارت تعمیر کر رکھی ہے اور غیر مجاز حصوں کی تعمیر سے علاقہ مکینوں کو مشکلات کا سامنا ہے۔
جسٹس راجپوت نے ریمارکس دیے کہ "اس علاقے میں سات منزلہ عمارت بنائی گئی ہے جہاں گراؤنڈ پلس ٹو سے اوپر کی عمارتوں کی اجازت نہیں ہے۔" "درخواست گزار کے مطابق، بلڈر کے پاس گراؤنڈ پلس ٹو ڈھانچہ بنانے کی اجازت بھی نہیں ہے،" عدالت نے مشاہدہ کیا۔
بنچ نے سوال کیا کہ "ایس بی سی اے حکام کے تعاون کے بغیر تعمیر کیسے ممکن ہے؟"
عدالت نے غیر قانونی ڈھانچہ سیل کرنے اور بلڈر کے خلاف فوجداری قانون کے تحت ایک ہفتے میں کارروائی کا حکم دے دیا۔ بنچ نے بلڈنگ کنٹرول اتھارٹی کے اہلکاروں کے خلاف بھی کارروائی کا حکم دیا۔
