Govt to implement new laws to fast-track CPEC projects

The Cabinet Committee has recently approved a draft law relating to CPEC Authority. The law will get ratified by the federal cabinet before going to National Assembly. For the sake of monitoring, coordinating, and evaluating CPEC-oriented activities,

The CPEC Authority was established through CPEC Authority Ordinance 2019 on 5^th October 2019. On 31^st May 2020, the ordinance expired after the grant of a one-time extension of 120 days. This resulted in the dissolution of CPEC.

According to the proposed law, the abolishment of the position of chief executive officer of CPEC Authority is required, reducing the powers of CPEC Authority chairman in decision making and putting a full stop to CPEC`s Authority to establish the Business Council of CPEC.

The Authority running the council can get assisted or facilitated by the government or a representative appointed by the provinces and terrains. Under the new law, the provinces and terrains can appoint a representative for assisting the authority in functioning.

The decisions of authority will be made by the majority of total members and will be finalized with the consentient of a minimum of two-thirds of total members.

There will be a CPEC Business Council to be informed by the Board of Investment, which will direct the authority in accordance with the memorandum of understanding (MoU) signed between the National Development and Reforms Commission of China and Pakistan’s Ministry of Planning Development and Special Initiatives. The BOI will be the secretariat of the business council.

Also proposed that a single line budget will be given to authority and the chairperson will be the main accounting officer. The budget prepared will be reviewed by the budget committee comprised of three members, two nominated by CPEC Authority, and one by the administrative authority. On the terms and conditions approved by the finance division, the authority can establish CPEC Fund if required.

The new law proposal was delivered to the prime minister`s office who further required its draft legislation for consideration of Cabinet, after going through it.

اسلام آباد: پیر کو ایک ذریعے کے ذریعہ معلوم ہوا ہے کہ چین پاکستان اقتصادی راہداری (سی پی ای سی) کے منصوبوں میں تیزی لانے کے لئے حکومت نئے قوانین متعارف کرانے کی منصوبہ بندی کر رہی ہے۔

کابینہ کمیٹی نے حال ہی میں سی پی ای سی اتھارٹی سے متعلق ایک مسودہ قانون کی منظوری دے دی ہے۔ قومی اسمبلی میں جانے سے پہلے اس قانون کی وفاقی کابینہ سے توثیق ہوجائے گی۔ سی پی ای سی پر مبنی سرگرمیوں کی نگرانی ، ہم آہنگی اور تشخیص کی خاطر

سی پی ای سی اتھارٹی 5 اکتوبر 2019 کو سی پی ای سی اتھارٹی آرڈیننس 2019 کے ذریعے قائم کی گئی تھی۔ 31 مئی 2020 کو ، آرڈیننس کی مدت ایک دن میں ایک دن کی توسیع کی منظوری کے بعد ختم ہوگئی۔ اس کے نتیجے میں سی پی ای سی کو تحلیل کردیا گیا۔

مجوزہ قانون کے مطابق ، سی پی ای سی اتھارٹی کے چیف ایگزیکٹو آفیسر کے عہدے کے خاتمے کی ضرورت ہے ، فیصلہ لینے میں سی پی ای سی اتھارٹی کے چیئرمین کے اختیارات کو کم کرنا اور سی پی ای سی کی اتھارٹی کو مکمل اسٹاپ لگانا سی پی ای سی کی بزنس کونسل کے قیام کے لئے ہے۔

کونسل چلانے والی اتھارٹی حکومت یا صوبوں اور علاقوں کی طرف سے مقرر کردہ نمائندہ کی مدد یا سہولت حاصل کر سکتی ہے۔ نئے قانون کے تحت ، صوبے اور علاقے کام کرنے میں اتھارٹی کی مدد کرنے کے لئے ایک نمائندہ مقرر کرسکتے ہیں۔

اتھارٹی کے فیصلے کل ممبروں کی اکثریت کے ذریعہ ہوں گے اور کل ممبروں کے کم سے کم دوتہائی حصے کی رضامندی کے ساتھ اس کا حتمی فیصلہ کیا جائے گا۔

سی پی ای سی بزنس کونسل کو انویسٹمنٹ بورڈ کے ذریعہ آگاہ کیا جائے گا ، جو چین کے نیشنل ڈویلپمنٹ اینڈ ریفارمز کمیشن اور پاکستان کی وزارت منصوبہ بندی کی ترقی اور خصوصی اقدامات کے مابین دستخط شدہ یادداشت (ایم او یو) کے مطابق اتھارٹی کو ہدایت کرے گی۔ . بی او آئی بزنس کونسل کا سیکرٹریٹ ہوگا۔

یہ بھی تجویز کیا کہ سنگل لائن بجٹ اتھارٹی کو دیا جائے گا اور چیئرپرسن مین اکاؤنٹنگ آفیسر ہوں گے۔ تیار کردہ بجٹ میں تین ممبروں پر مشتمل بجٹ کمیٹی کا جائزہ لیا جائے گا ، دو سی پی ای سی اتھارٹی کے ذریعہ نامزد اور ایک انتظامی اختیار کے ذریعہ۔ فنانس ڈویژن کے ذریعہ منظور شدہ شرائط و ضوابط پر ، اتھارٹی اگر ضرورت ہو تو سی پی ای سی فنڈ قائم کرسکتی ہے۔

قانون کی نئی تجویز وزیر اعظم کے دفتر کو پہنچا دی گئی تھی جس نے کابینہ پر غور کرنے کے لئے اس کے مسودہ قانون سازی کی مزید ضرورت کے بعد اس کے پاس جانے کے بعد اس کی منظوری دی تھی۔
