Foreign Assets of Residents are Subject to Tax: Lahore High Court (LHC)

The LHC has made a thorough ruling on this matter. The order declares that section 8(2)(b) of the Finance Act of 2022 is legitimate, constitutional, and within the bounds of the law.

Arguments made by the petitioner that no taxes may be levied on foreign assets in respect of which declarations were made under amnesty programmes provided by the federal government are futile.

Tax on asset capital cannot be interpreted as a municipal tax, which would otherwise be imposed on overseas real estate.

Unquestionably, Provincial legislatures have the authority to impose taxes on real estate located within their respective jurisdictions, regardless of the owner's residence or domicile, who may not be a resident of the province where the property is located. For instance, real estate located in the city of Lahore is subject to taxation under the terms of the Punjab Urban Immovable Property Tax Act 1958.
