Demolition of illegal marriage halls in Karachi : SC

A three-member bench of the Supreme Court, led by Chief Justice of Pakistan Gulzar Ahmed, heard various appeals relevant to marriage halls at the apex court’s Karachi Registry.

Advocate Anwar Mansoor Khan, counsel for Korangi Marriage Halls Association, prayed that the marriage halls of Korangi were situated on a commercial strip, and carry legal status.

“The SBCA (Sindh Building Control Authority) should be stopped from demolishing the wedding halls. People do not like to live right on the roadside, that is why the strip has been commercialized,” the council said.

The CJP replied to it that was an assumption, and it does not mean that everything should be commercialized. SBCA had no authority to take such a step, the chief justice added.

Addressing the Karachi commissioner, the chief justice said that marriage halls were being constructed all over Karachi.

“Most of the marriage halls were built on welfare plots. Go and demolish illegal marriage halls.”

Expressing disapproval, the CJP referred to the Karachi commissioner and asked where would the people go and were they provided with an alternative.

On this, the commissioner responded that alternate arrangements would be made as soon as the provincial government’s compensation policy was formed.

“You think we will take the deputy commissioner’s report seriously? What type of a report is this?” he asked the chief secretary.

“It’s written everywhere that the report is awaited. Chief Secretary Sahab remove such officers.”

The Karachi Commissioner presented a report relevant to the YMCA Ground during the hearing, saying that all pending work has been completed except for the installation of lights on the ground.

“If you are creating so many problems for us, imagine the number of problems you create for the people,” remarked the chief justice.

چیف جسٹس پاکستان گلزار احمد کی سربراہی میں سپریم کورٹ کے تین رکنی بینچ نے عدالت عظمیٰ کراچی رجسٹری میں شادی ہالوں سے متعلق متعدد اپیلوں کی سماعت کی۔

کورنگی میرج ہالز ایسوسی ایشن کے وکیل ایڈووکیٹ انور منصور خان نے دعا کی کہ کورنگی کے شادی ہال تجارتی پٹی پر واقع تھے ، اور قانونی حیثیت رکھتے ہیں۔

ایس بی سی اے (سندھ بلڈنگ کنٹرول اتھارٹی) کو شادی ہالوں کو منہدم کرنے سے روکا جائے۔ وکیل سڑک کے کنارے رہنا پسند نہیں کرتے ، اسی وجہ سے اس پٹی کا کاروبار کیا گیا ہے۔

چیف جسٹس نے اس کے جواب میں کہا کہ یہ ایک مفروضہ تھا ، اور اس کا مطلب یہ نہیں ہے کہ ہر چیز کو تجارتی بنایا جائے۔ چیف جسٹس نے مزید کہا کہ ایس بی سی اے کے پاس ایسا قدم اٹھانے کا کوئی اختیار نہیں ہے۔

چیف جسٹس نے کراچی کمشنر سے خطاب کرتے ہوئے کہا کہ پورے کراچی میں شادی ہال تعمیر ہورہے ہیں۔

“زیادہ تر شادی ہال فلاحی پلاٹوں پر تعمیر ہوئے تھے۔ جاؤ اور غیر قانونی شادی ہالوں کو مسمار کرو۔ "

چیف جسٹس نے ناپسندیدگی کا اظہار کرتے ہوئے کراچی کمشنر سے رجوع کیا اور کہا کہ لوگ کہاں جائیں گے اور کیا انہیں متبادل فراہم کیا گیا ہے؟

اس پر کمشنر نے جواب دیا کہ صوبائی حکومت کی معاوضہ پالیسی بنتے ہی متبادل انتظامات کیے جائیں گے۔

“آپ کو لگتا ہے کہ ہم ڈپٹی کمشنر کی رپورٹ کو سنجیدگی سے لیں گے؟ یہ کس قسم کی رپورٹ ہے؟ انہوں نے چیف سکریٹری سے پوچھا۔

“یہ ہر جگہ لکھا ہے کہ رپورٹ کا انتظار ہے۔ چیف سکریٹری صاحب ایسے افسروں کو ہٹا دیں۔

سماعت کے دوران کراچی کمشنر نے وائی ایم سی اے گراؤنڈ سے متعلق ایک رپورٹ پیش کرتے ہوئے کہا کہ زمین پر لائٹس کی تنصیب کے سوا تمام زیر التواء کام مکمل کرلیا گیا ہے۔

چیف جسٹس نے ریمارکس دیئے ، "اگر آپ ہمارے لئے بہت سارے مسائل پیدا کررہے ہیں تو ، لوگوں کے لئے آپ کی تعداد میں پیدا ہونے والے مسائل کا تصور کریں۔
