Court issues orders to SBCA on illegal constructions

It was a panel of two-member, headed by Justice Irfan Saadat Khan, and consisted of Justice Yousuf Ali Sayeed along who heard the case.

During the hearing, the counsel representative of SBCA, advocate Tariq Mansoor resigned from his office. As per him, being part of the panel is of no use when he could not have justice in the previous one and a half years.

Justice Khan asked the counsel not to get emotional. He further said that attaining a job in this country is not a piece of cake. It takes time to settle down legal matters but in the end justice gets served.

He added that one and a half years mostly flies in issuing the notices, replies` submission, and counter replies.

The SCBA`s counsel pointed out that the whole residential area has been converted into an industrial zone, also the sewage system of the area has been destroyed. 

The bench asked that why doesn`t SBCA take any step against the illegal constructions.

The court extended the hearing till 20th January 2021 and asked the SBCA DG to come before the court over the next hearing, in a personal capacity.

Additionally, the DG of SBCA was directed for taking an action against illegal constructions happening, after reviewing the entire case.

کراچی: سندھ ہائی کورٹ کے ایک پینل نے بہادرآباد کے رہائشی علاقے میں غیر قانونی تعمیرات کے خلاف کیس کی آئندہ سماعت پر سندھ بلڈنگ کنٹرول اتھارٹی کے ڈائریکٹر جنرل کو حکم دیتے ہوئے نوٹسز جاری کردیئے۔

یہ جسٹس عرفان سعادت خان کی سربراہی میں دو رکنی ایک پینل تھا ، اور اس کیس کی سماعت کرنے والے جسٹس یوسف علی سید پر مشتمل تھا۔

سماعت کے دوران ایس بی سی اے کے مشیر نمائندے ایڈووکیٹ طارق منصور نے اپنے عہدے سے استعفیٰ دے دیا۔ بقول ان کے ، پینل کا حصہ بننے کا کوئی فائدہ نہیں جب پچھلے ڈیڑھ سالوں میں اسے انصاف نہیں مل سکا۔

جسٹس خان نے وکیل سے جذباتی نہ ہونے کو کہا۔ ان کا مزید کہنا تھا کہ اس ملک میں نوکری کا حصول کیک کا ٹکڑا نہیں ہے۔ قانونی معاملات طے کرنے میں وقت لگتا ہے لیکن آخر کار انصاف ملتا ہے۔

انہوں نے مزید کہا کہ ڈیڑھ سال زیادہ تر نوٹسز ، جوابات جمع کروانے ، اور جوابی جوابات دینے میں اڑ جاتا ہے۔

ایس سی بی اے کے وکیل نے نشاندہی کی کہ پورا رہائشی رقبہ صنعتی زون میں تبدیل کردیا گیا ہے ، اس علاقے کا نکاسی آب کا نظام بھی تباہ ہوگیا ہے۔

بنچ نے پوچھا کہ غیر قانونی تعمیرات کے خلاف ایس بی سی اے کوئی اقدام کیوں نہیں کرتا ہے؟

عدالت نے سماعت 20 جنوری 2021 تک بڑھا دی اور ایس بی سی اے کے ڈی جی سے کہا کہ وہ ذاتی حیثیت میں آئندہ سماعت پر عدالت کے روبرو حاضر ہوں۔

مزید برآں ، ایس بی سی اے کے ڈی جی کو ہدایت کی گئی کہ غیرقانونی تعمیرات رونما ہونے کے خلاف کارروائی کی جائے۔
