Construction of Kamran Tessori's Tejori Tower delayed Due to Disputes

The matter has been brought to Sindh High Court for the second time in four years. The Tejori Tower project is the project of Karachi Tower Builders & Developers. The company`s proprietor is Javed Iqbal Qureshi, the father-in-law of a businessman and a politician, Kamran Tessori who is a partner in the construction business of his father-in-law.

An FIR was registered against Tessori at Railways Police Station on 20th November, according to which Tessori of Tejori Heights is carrying out construction over the land measuring 2,783 square yard that belongs to Pakistan Railways.

Further, as per FIR, the unauthorized multi-story plaza for residential and commercial purposes is being illegally constructed. The Fir has been lodged under the Federal Government Land & Building Ordinance. The Pakistan Railways claims that as it falls under Survey No 190 of Deh Gujro In Gulshan-e-Iqbal, hence the land belongs to them. While the Karachi Town Builders & developers claim that as the land falls under Survey No 653 of Deh Gujro in the Board`s land records, therefore it belongs to them.

This is unfair as the case is in court and has yet to be decided, but the police have stopped the construction work forcibly,” says Tessori.

He added that we have an approved layout plan by the Master Plan Department and a forwarding letter from the land-owning agency. Moreover, a contempt order is issued by the court, against the Pakistan Railways authorities as they deployed their police at the project site. No objection was raised over the plot survey number by the Sindh government`s mukhtiarkar and supervising tapedar when the survey superintendent conducted the site`s field survey in their presence.

“If the court issues a verdict against Karachi Town Builders & Developers, then the SBCA will take action against the project and will either seal or demolish the structure,” said the SBCA`s director of town planning and regulations department.

یہ معاملہ چار سالوں میں دوسری بار سندھ ہائی کورٹ میں لایا گیا ہے۔ تیجوری ٹاور منصوبہ کراچی ٹاور بلڈرز اینڈ ڈویلپرز کا منصوبہ ہے۔ کمپنی کا مالک جاوید اقبال قریشی ہے جو ایک تاجر اور سیاستدان کامران ٹیسوری کا سسر ہے جو اپنے سسر کے تعمیراتی کاروبار میں شریک ہے۔

20 نومبر کو ٹیسوری کے خلاف ریلوے پولیس اسٹیشن میں ایک ایف آئی آر درج کی گئی تھی ، جس کے مطابق تیجوری ہائٹس کا ٹیسوری 2،783 مربع گز کی اراضی پر تعمیرات کررہا ہے جو پاکستان ریلوے کی ملکیت ہے۔

مزید یہ کہ ایف آئی آر کے مطابق رہائشی اور تجارتی مقاصد کے لئے غیر مجاز کثیر المنزلہ پلازہ غیر قانونی طور پر تعمیر کیا جارہا ہے۔ ایف آئی آر کو فیڈرل گورنمنٹ لینڈ اینڈ بلڈنگ آرڈیننس کے تحت درج کیا گیا ہے۔ پاکستان ریلوے کا دعویٰ ہے کہ چونکہ یہ گلشنِ اقبال میں ڈیہ گجرو کے سروے نمبر 190 کے تحت آتا ہے ، لہذا یہ زمین ان کی ملکیت ہے۔ جبکہ کراچی ٹاؤن بلڈرز اور ڈویلپرز کا دعویٰ ہے کہ چونکہ یہ بورڈ بورڈ کے اراضی ریکارڈوں میں ڈیہ گجرو کے سروے نمبر 653 کے تحت آتا ہے ، لہذا یہ ان کی ملکیت ہے۔

یہ غیر منصفانہ ہے کیونکہ یہ کیس عدالت میں ہے اور ابھی اس کا فیصلہ ہونا باقی ہے ، لیکن پولیس نے زبردستی تعمیراتی کام روک دیا ہے ، "ٹیسوری کہتے ہیں۔

انہوں نے مزید کہا کہ ہمارے پاس ماسٹر پلان ڈیپارٹمنٹ کا منظور شدہ ترتیب منصوبہ ہے اور لینڈ واجب الادا ایجنسی کا ایک فارورڈنگ لیٹر ہے۔ مزید برآں ، عدالت نے پاکستان ریلوے کے حکام کے خلاف توہین عدالت کا حکم جاری کیا تھا کیونکہ انہوں نے اپنی پولیس کو پراجیکٹ سائٹ پر تعینات کیا تھا۔ جب سروے کے سپرنٹنڈنٹ نے ان کی موجودگی میں سائٹ کے فیلڈ سروے کیا تو سندھ حکومت کے مختیارکر اور ٹیپر کی نگرانی میں پلاٹ سروے نمبر پر کوئی اعتراض نہیں اٹھایا گیا۔

ایس بی سی اے کے ڈائریکٹر ٹاؤن پلاننگ اینڈ قواعد و ضوابط کے محکمہ ایس بی سی اے نے کہا ، "اگر عدالت کراچی ٹاؤن بلڈرز اینڈ ڈویلپرز کے خلاف فیصلہ جاری کرتی ہے تو ایس بی سی اے اس منصوبے کے خلاف کارروائی کرے گی اور یا تو اس ڈھانچے کو سیل کردے گی یا اسے مسمار کردے گی۔"
