Bahria Town submits proposal for constructing Low-Cost Apartments in Karachi & Islamabad

The Supreme Court has been informed of a possible MoU with Bahria Town which under a deal with the apex court is to pay Rs460 billion as part of an arrangement to settle the Malir land dispute.

The report said Bahria Town had submitted two proposals to the Naya Pakistan Housing Development Authority for the construction of low-cost housing schemes in Islamabad and Karachi consisting of 3,000 and 2,000 apartments, respectively.

“The proposals are being evaluated and the NAPHDA is likely to sign an MoU with BTPL in respect of these proposals,” said the report furnished by Additional Attorney General Sohail Mahmood before the SC implementation bench.

The bench had on March 21, 2019, accepted Bahria Town’s offer to pay Rs460bn for the purchase of land measuring 16,896 acres in Malir, Karachi, but on certain terms and conditions.

The offer was accepted to implement the apex court’s May 4, 2018, judgment which had held the grant of land to the MDA by the Sindh government.

Its exchange with the land of private developer Bahria Town and anything done under the provisions of the Colonisation of Government Land Act, 1912 by the provincial government illegal and of no legal existence.

The land was granted for launching an incremental housing scheme, but the MDA exchanged it with Bahria Town to launch a scheme of its own, the SC verdict had regretted.

سپریم کورٹ کو بحریہ ٹاؤن کے ساتھ ممکنہ مفاہمت نامہ کے بارے میں بتایا گیا ہے جس میں عدالت عظمی کے ساتھ معاہدے کے تحت ملیر اراضی کے تنازعہ کو حل کرنے کے انتظامات کے تحت 460 ارب روپے ادا کرنے ہیں۔

رپورٹ میں کہا گیا کہ بحریہ ٹاؤن نے اسلام آباد اور کراچی میں بالترتیب 3،000 اور 2 ہزار اپارٹمنٹس پر مشتمل کم لاگت ہاؤسنگ اسکیموں کی تعمیر کے لئے نیا پاکستان ہاؤسنگ ڈویلپمنٹ اتھارٹی کو دو تجاویز پیش کی ہیں۔

ایڈیشنل اٹارنی جنرل سہیل محمود نے ایس سی عمل درآمد بینچ کے سامنے پیش کردہ رپورٹ میں کہا ، "ان تجاویز کا جائزہ لیا جارہا ہے اور امکان ہے کہ نیپڈا ان تجاویز کے سلسلے میں بی ٹی پی ایل کے ساتھ ایک مفاہمت نامے پر دستخط کرے گا۔"

بنچ نے 21 مارچ ، 2019 کو ملیر ، کراچی میں 16،896 ایکڑ رقبہ اراضی کی خریداری کے لئے بحریہ ٹاؤن کی 460bn کی ادائیگی کی پیش کش قبول کی ، لیکن کچھ شرائط و ضوابط پر۔

اس پیش کش کو عدالت عظمیٰ کے 4 مئی ، 2018 کے فیصلے کو نافذ کرنے کے لئے قبول کیا گیا ، جس نے سندھ حکومت کے ذریعہ ایم ڈی اے کو زمین کی گرانٹ حاصل کی تھی۔

اس کا تبادلہ نجی ڈویلپر بحریہ ٹاؤن کی اراضی اور صوبائی حکومت کے ذریعہ کالونیائزیشن آف گورنمنٹ لینڈ ایکٹ ، 1912 کی دفعات کے تحت کیا گیا غیر قانونی اور کوئی قانونی وجود نہیں۔

انکریمنٹ ہاؤسنگ اسکیم شروع کرنے کے لئے یہ زمین دی گئی تھی ، لیکن ایم ڈی اے نے بحریہ ٹاؤن کے ساتھ اس کا تبادلہ اپنی اسکیم شروع کرنے کے لئے کیا ، ایس سی فیصلے پر افسوس ہوا۔
