Tribunal Suspends IEE Approval for Karachi's Seaview Beach ‘Commercialisation’

An environmental tribunal has suspended the Initial Environmental Examination (IEE) approval accorded by the Sindh Environmental Protection Agency (Sepa) to a project meant for allegedly commercializing the seafront in the name of development by the Cantonment Board Clifton (CBC).

Headed by its chairman retired Justice Nisar Muhammad Shaikh, the tribunal also remanded the matter back to Sepa with the direction to decide the same afresh in accordance with the law.

The tribunal passed these directives while disposing of an appeal filed by a group of citizens, including Arif Belgaumi, Sharmeen Obaid-Chinoy, Ayesha Tammy Haq, and others, expressing their concerns about the proposed commercialization of the seafront from Nishan-i-Pakistan Park to Chunky Monkey in the Phase-V of the Defence Housing Authority.

Their counsel submitted that the CBC had purportedly in compliance with Section 17 of the Sindh Environmental Protection Act, 2014 had filed an IEE report with Sepa on Dec 18, 2019, about the project spread over 20.89 acres, which entails the development of a one-kilometer-long Seaview beach.

“It is planned to build two beach docks, a jogging track, fountains, monuments, restaurants, and tuck shops, hawkers and street stalls, a children’s play area, green areas spreading over 13.5 acres and watchtowers,” they explained.

They alleged the said project was actually a part of a plan for commercialization of the Clifton beach, which the CBC was attempting for many years, adding that the CBC was occupying the beach in parts from Dolman Mall to Village Restaurant.

It allowed construction of the Dolmen Mall on an amenity plot and commercialized the area adjacent to it for private car parking and on its other side the area was used for discharge of untreated solid waste into the sea after a commercial fast-food outlet was constructed and adjacent to it a few years ago new boundary walled Nishan-i-Pakistan Park was constructed.

ماحولیاتی ٹربیونل نے کنٹونمنٹ بورڈ کلفٹن (سی بی سی) کی جانب سے ڈیولپمنٹ کے نام پر سی فرنٹ کو مبینہ طور پر کمرشلائز کرنے کے منصوبے کے لیے سندھ انوائرمینٹل پروٹیکشن ایجنسی (سیپا) کی جانب سے دی گئی ابتدائی ماحولیاتی امتحان (آئی ای ای) کی منظوری کو معطل کر دیا ہے۔

اس کے چیئرمین ریٹائرڈ جسٹس نثار محمد شیخ کی سربراہی میں، ٹربیونل نے قانون کے مطابق نئے سرے سے فیصلہ کرنے کی ہدایت کے ساتھ معاملہ سیپا کو واپس بھیج دیا۔

ٹربیونل نے یہ ہدایات شہریوں کے ایک گروپ کی طرف سے دائر کی گئی اپیل کو نمٹاتے ہوئے دی ہیں، جن میں عارف بیلگامی، شرمین عبید چنائے، عائشہ تمی حق اور دیگر شامل ہیں، جس میں نشان پاکستان پارک سے سمندری محاذ کی مجوزہ کمرشلائزیشن کے بارے میں اپنے خدشات کا اظہار کیا گیا تھا۔ ڈیفنس ہاؤسنگ اتھارٹی کے فیز-V میں چنکی بندر۔

ان کے وکیل نے عرض کیا کہ سی بی سی نے سندھ انوائرمینٹل پروٹیکشن ایکٹ 2014 کے سیکشن 17 کی تعمیل میں مبینہ طور پر 20.89 ایکڑ پر پھیلے اس پروجیکٹ کے بارے میں 18 دسمبر 2019 کو سیپا کے پاس آئی ای ای رپورٹ دائر کی تھی، جس میں ایک کلومیٹر کی ترقی شامل ہے۔

رہائشیوں نے نشانِ پاکستان پارک سے چنکی بندر تک ایک کلومیٹر طویل ساحل کی ترقی کو چیلنج کیا-

انہوں نے وضاحت کرتے ہوئے کہا کہ "دو بیچ ڈاک، ایک جاگنگ ٹریک، فوارے، یادگاریں، ریستوراں اور ٹک شاپس، ہاکرز اور اسٹریٹ اسٹالز، بچوں کے کھیل کا میدان، 13.5 ایکڑ پر پھیلے سبز علاقے اور واچ ٹاورز بنانے کا منصوبہ ہے۔"

انہوں نے الزام لگایا کہ مذکورہ منصوبہ درحقیقت کلفٹن بیچ کو کمرشلائز کرنے کے منصوبے کا حصہ تھا، جس کی سی بی سی کئی سالوں سے کوشش کر رہی تھی، انہوں نے مزید کہا کہ سی بی سی نے ڈولمین مال سے ولیج ریسٹورنٹ تک ساحل سمندر پر قبضہ کر رکھا ہے۔

اس نے ایک سہولت والے پلاٹ پر ڈولمین مال کی تعمیر کی اجازت دی اور اس سے ملحقہ علاقے کو پرائیویٹ کار پارکنگ کے لیے کمرشلائز کیا اور اس کی دوسری طرف کمرشل فاسٹ فوڈ آؤٹ لیٹ کی تعمیر کے بعد اس علاقے کو بغیر ٹریٹ کیے جانے والے ٹھوس فضلہ کو سمندر میں خارج کرنے کے لیے استعمال کیا گیا۔ اس سے متصل چند سال قبل چار دیواری والا نشان پاکستان پارک تعمیر کیا گیا تھا۔
