Supreme court cancels allotment of land to KMC housing society

According to the news sources, this decision was taken by the supreme court on Tuesday. Headed by Chief Justice of Pakistan Gulzar Ahmed, a two-judge Supreme court bench also held the approval approved by the Sindh government as void with a direction to the Karachi administrator to forthwith retrieve the lands allotted to the society.

The bench has decided during the hearing of the case relating to the illegal allotment of amenity plots for commercial and residential purposes at the Gutter Baghicha area.

According to the news sources, Earlier, during the Dec 28 hearing in Karachi, the court had ordered the authorities to instantly restore Gutter Baghicha and remove all encroachments built on it. “For a city with a population of 30 million, there should at least be 300,000 parks,” the chief justice had remarked then.

In the court’s recent decision, the court canceled the allotment of Gutter Baghicha land and directed the Karachi administrator to remove the encroachments established upon the plots immediately.

نیوز ذرائع کے مطابق یہ فیصلہ سپریم کورٹ نے منگل کو سنایا۔ چیف جسٹس آف پاکستان گلزار احمد کی سربراہی میں سپریم کورٹ کے دو رکنی بینچ نے سندھ حکومت کی جانب سے دی گئی منظوری کو کالعدم قرار دیتے ہوئے کراچی کے ایڈمنسٹریٹر کو سوسائٹی کو الاٹ کی گئی زمینیں فوری طور پر واپس لینے کا حکم دیا۔
بنچ نے یہ فیصلہ گٹر باغیچہ کے علاقے میں کمرشل اور رہائشی مقاصد کے لیے سہولتی پلاٹوں کی غیر قانونی الاٹمنٹ سے متعلق کیس کی سماعت کے دوران دیا ہے۔
نیوز ذرائع کے مطابق اس سے قبل کراچی میں 28 دسمبر کو ہونے والی سماع�� کے دوران عدالت نے حکام کو گٹر باغیچہ کو فوری طور پر بحال کرنے اور اس پر قائم تمام تجاوزات ہٹانے کا حکم دیا تھا۔ اس وقت چیف جسٹس نے ریمارکس دیئے تھے کہ 30 ملین کی آبادی والے شہر کے لیے کم از کم 300,000 پارکس ہونے چاہئیں۔
عدالت کے حالیہ فیصلے میں عدالت نے گٹر باغیچہ کی اراضی کی الاٹمنٹ منسوخ کرتے ہوئے کراچی کے ایڈمنسٹریٹر کو پلاٹوں پر قائم تجاوزات کو فوری طور پر ہٹانے کا حکم دیا۔
