Sindh High Court orders to remove encroachments from Hyderabad

At a hearing of a petition concerning the encroachment by Waqar Town Housing Scheme located on a 60-feet Government road in Qasimabad, the bench was informed that both the HMC and QMC had issued licenses to the business to occupy certain footpaths, Road, and public Places for their commercial activities.

The deputy commissioner DC FuasGhafferSomro apprised the court that whenever they undertook an anti-encroachment operation to clear footpaths and roads the traders showed them the licenses issued by HMC and QMC.

DC and the administrators submitted an undertaking that all of the existing encroachment would be cleared in the next 1 month.

The bench directed the officials to remove all violation charges including those which possess the municipal licenses before the next date of a hearing scheduled for March 2.

“All such purported licenses are void and as such the purported licenses don’t have any right, title, and interest in respect of the portions of footpaths, roads, and public places,” the court-ordered.

حیدرآباد: سندھ ہائی کورٹ حیدرآباد سرکٹ بینچ نے حیدرآباد میونسپل کارپوریشن (ایچ ایم سی) ، ضلعی انتظامیہ ، قاسم آباد میونسپل کمیٹی (کیو ایم سی) کو حکم دیا ہے کہ وہ تمام تجاوزات کو حیدرآباد سے کم سے کم ایک ماہ میں ختم کریں۔

قاسم آباد میں 60 فٹ سرکاری روڈ پر واقع وقار ٹاؤن ہاؤسنگ اسکیم کے ذریعہ تجاوزات سے متعلق درخواست کی سماعت کے دوران ، بینچ کو بتایا گیا کہ ایچ ایم سی اور کیو ایم سی دونوں نے کاروبار کو کچھ فٹ پاتھوں ، روڈ ، اور قبضہ کرنے کے لئے لائسنس جاری کیے ہیں۔ عوامی اپنی تجارتی سرگرمیوں کے لئے مقامات۔

ڈپٹی کمشنر ڈی سی فوس غفار سومرو نے عدالت کو آگاہ کیا کہ جب بھی انہوں نے فٹ پاتھوں اور سڑکیں صاف کرنے کے لئے انسداد تجاوزات آپریشن کیا تو تاجروں نے انہیں ایچ ایم سی اور کیو ایم سی کے ذریعہ جاری لائسنس دکھایا۔

ڈی سی اور منتظمین نے یہ وعدہ پیش کیا کہ موجودہ تمام تجاوزات کو اگلے 1 ماہ میں ختم کردیا جائے گا۔

بینچ نے عہدیداروں کو ہدایت کی کہ وہ 2 مارچ کو شیڈول کی اگلی تاریخ سے قبل میونسپلٹی لائسنس رکھنے والے تمام خلاف ورزی کے الزامات کو ختم کردیں۔

عدالت نے حکم دیا کہ "اس طرح کے تمام لائسنس کالعدم ہیں اور ایسے ہی لائسنسوں کو فٹ پاتھوں ، سڑکوں اور عوامی مقامات کے حصوں کے سلسلے میں کوئی حق ، لقب اور دلچسپی حاصل نہیں ہے۔"
