New verges on real estate dealings

According to the news sources, this act is set to increase property valuation rates in 40 major cities of Pakistan. The condition to suspend business with the unregistered real estate agents will come into effect on January 1, 2022, according to a notice issued by the Federal Board of Revenue (FBR) here on Monday.

“Any violation of this notice shall attract penal provisions under the AML Act 2010 and AML/CFT Sanctions Rules 2020,” warned the FBR.

In this case, FBR has allotted the new order for the development of housing authorities to discipline real estate agents, who have to get registered with the tax machinery under the AML Act 2010.

The AML law authorizes the FBR to issue a license or register real estate agents under the Designated Non-Financial Businesses and Professions (DNFBPs) to prevent the offenses of money laundering, predicate offenses, or financing of terrorism.

According to the order, “No public or private development authority shall conduct the business activity with any real estate agent for the transfer or registration of property unless the real estate agent is registered with the FBR as the selected Non-Financial Business and Profession (DNFBP),”

This condition will apply to all real estate agents registered or dealing with development authorities, housing authorities, cooperative housing societies, and other housing schemes dealing in the development of land for residential and commercial purposes, construction and sale/purchase, or transfer of ownership rights.

نیوز ذرائع کے مطابق یہ ایکٹ پاکستان کے 40 بڑے شہروں میں پراپرٹی ویلیوایشن ریٹ بڑھانے کے لیے تیار ہے۔ پیر کو یہاں فیڈرل بورڈ آف ریونیو (ایف بی آر) کے جاری کردہ نوٹس کے مطابق، غیر رجسٹرڈ رئیل اسٹیٹ ایجنٹس کے ساتھ کاروبار معطل کرنے ��ی شرط یکم جنوری 2022 سے نافذ العمل ہوگی۔
"اس نوٹس کی کسی بھی خلاف ورزی پر (اے ایم ایل) ایکٹ 2010 اور (اے ایم ایل/سی ایف ٹی) سینکشنز رولز 2020 کے تحت تعزیری دفعات لگائی جائیں گی،" (ایف بی آر) نے خبردار کیا۔
اس معاملے میں ایف بی آر نے رئیل اسٹیٹ ایجنٹس کو نظم و ضبط کے لیے ہاؤسنگ اتھارٹیز کی ترقی کے لیے نیا آرڈر الاٹ کیا ہے، جنہیں اے ایم ایل ایکٹ 2010 کے تحت ٹیکس مشینری کے ساتھ رجسٹرڈ ہونا ہوگا۔
(اے ایم ایل) قانون (ایف بی آر) کو اجازت دیتا ہے کہ وہ لائسنس جاری کرے یا رئیل اسٹیٹ ایجنٹس کو نامزد غیر مالیاتی کاروبار اور پیشہ (ڈی این ایف بی پی ایس) کے تحت رجسٹر کرے تاکہ منی لانڈرنگ، پیش گوئی کے جرائم یا دہشت گردی کی مالی معاونت کو روکا جا سکے۔
آرڈر کے مطابق، "کوئی بھی پبلک یا پرائیویٹ ڈویلپمنٹ اتھارٹی کسی بھی رئیل اسٹیٹ ایجنٹ کے ساتھ جائیداد کی منتقلی یا رجسٹریشن کے لیے کاروباری سرگرمی نہیں کرے گی جب تک کہ رئیل اسٹیٹ ایجنٹ (ایف بی آر) کے ساتھ منتخب شدہ غیر مالیاتی کاروبار اور پیشہ (ڈی این ایف بی پی) کے طور پر رجسٹرڈ نہ ہو۔ "
یہ شرط ان تمام رئیل اسٹیٹ ایجنٹوں پر لاگو ہوگی جو رجسٹرڈ یا ترقیاتی اتھارٹیز، ہاؤسنگ اتھارٹیز، کوآپریٹو ہاؤسنگ سوسائٹیز اور دیگر ہاؤسنگ اسکیموں کے ساتھ کام کرتے ہیں جو رہائشی اور تجارتی مقاصد کے لیے زمین کی ترقی، تعمیر و فروخت/خریداری یا ملکیت کے حقوق کی منتقلی سے متعلق ہیں۔
