Illegal construction activities banned in Makhnyal Guzara Forests, Haripur

The district administration has banned all types of construction activities in Makhnyal Guzara Forests in Haripur district, besides registration of first information reports (FIRs) against 10 persons allegedly involved in illegal construction.

Deputy Commissioner Mugees Sanaullah, when contacted, said that all illegal construction has been stopped in Makhnial while imposing a ban under section-144. The official confirmed the registration of FIRs.

He said the constructions, which were already approved by TMA Khanpur, would also be verified by Galiyat Development Authority within two weeks. Replying to a query, he said that all those influential people who had purchased land in the Guzara forest area were not entitled to construction.

It may be pointed out that Chief Minister Mahmood Khan had taken notice of illegal construction activities being carried out in the Makhnyal forests area in Haripur and purchase as well as the sale of forested land for commercial purposes.

He had directed the quarters concerned to impose Section-144 to this effect, asking them to take strict action under Section-188 of the Pakistan Penal Code against those who violated Section-144.

Earlier, an inquiry committee was constituted on the directives of Chief Secretary Kazim Niaz against Makinal sub-division of Haripur, where the encroachment of forest land had occurred in violation of forestry laws. The area is sited adjacent to Islamabad’s Margalla Hills.

“The law is very clear about the land use of Guzara forests. Section-19 of the Forest Ordinance clearly stipulates that breakage of Guzara forests land and clearance of vegetation therefrom shall be strictly prohibited,” said an official of the environment department.

ضلعی انتظامیہ نے ضلع ہری پور کے مکھنیال گوزارہ جنگلات میں ہر قسم کی تعمیراتی سرگرمیوں پر پابندی عائد کی ہے ، اس کے علاوہ غیر قانونی تعمیرات میں مبینہ طور پر ملوث 10 افراد کے خلاف فرسٹ انفارمیشن رپورٹس (ایف آئی آر) کا اندراج بھی کیا گیا ہے۔

ڈپٹی کمشنر مغیث ثناء اللہ سے رابطہ کیا گیا تو انہوں نے کہا کہ سیکشن 144 کے تحت پابندی لگاتے ہوئے مکھنیال میں تمام غیر قانونی تعمیرات کو روک دیا گیا ہے۔ اہلکار نے ایف آئی آر کے اندراج کی تصدیق کی۔

انہوں نے کہا کہ تعمیرات ، جو کہ پہلے ہی ٹی ایم اے خان پور سے منظور شدہ ہیں ، گلیات ڈویلپمنٹ اتھارٹی کی طرف سے بھی دو ہفتوں میں تصدیق کی جائے گی۔ ایک سوال کے جواب میں انہوں نے کہا کہ وہ تمام بااثر افراد جنہوں نے گوزارہ جنگلاتی علاقے میں زمین خریدی تھی ، تعمیر کے حقدار نہیں تھے۔

واضح رہے کہ وزیراعلیٰ محمود خان نے ہری پور میں مکھنیال جنگلات کے علاقے میں غیر قانونی تعمیراتی سرگرمیوں کا نوٹس لیا تھا اور تجارتی مقاصد کے لیے جنگلات کی زمین کی خریداری کے ساتھ ساتھ فروخت کی تھی۔

انہوں نے متعلقہ حلقوں کو ہدایت کی تھی کہ وہ اس سلسلے میں دفعہ 144 نافذ کریں ، اور ان سے کہا کہ وہ دفعہ 144 کی خلاف ورزی کرنے والوں کے خلاف پاکستان پینل کوڈ کی دفعہ 188 کے تحت سخت کارروائی کریں۔

اس سے قبل ہری پور کے مکینل سب ڈویژن کے خلاف چیف سیکرٹری کاظم نیاز کی ہدایت پر ایک انکوائری کمیٹی تشکیل دی گئی تھی ، جہاں جنگلات کے قوانین کی خلاف ورزی کرتے ہوئے جنگلات کی زمین پر تجاوزات ہوئی تھیں۔ یہ علاقہ اسلام آباد کی مارگلہ پہاڑیوں سے متصل ہے۔

"قانون گوزارا جنگلات کے زمینی استعمال کے بارے میں بہت واضح ہے۔ محکمہ جنگلات کے ایک عہدیدار نے کہا کہ جنگلات کے آرڈیننس کے سیکشن 19 میں واضح طور پر کہا گیا ہے کہ گوزارہ کے جنگلات کی زمین کو توڑنا اور پودوں کی صفائی کو سختی سے منع کیا جائے گا۔
