FIA Ordered To Probe Irregularities in ETPB Properties Sale

The Supreme Court on Tuesday ordered the Federal Investigation Agency (FIA) to conduct an inquiry on the Auditor General of Pakistan’s (AGP) report about alleged irregularities of over Rs77 billion in the sale of 7,143 urban properties in different parts of the country owned by the Evacuee Trust Property Board (ETPB).

A two-judge Supreme Court bench headed by Chief Justice Gulzar Ahmed was hearing a petition filed by Pakistan Hindu Council (PHC) patron Dr. Ramesh Kumar Vankwani complaining that the apex court’s directives about the protection of properties belonging to minority communities were not being implemented. The court ordered the FIA to conduct the inquiry in a month.

The directive was issued when the apex court was told that the AGP had discovered the irregularities though the ETPB did not extend complete assistance and shared only half of the information to the auditors.

Dr. Shoaib Suddle, the head of the one-man commission on minorities’ rights, had highlighted the audit report of the AGP.

The court ordered the ETPB to extend complete cooperation to the AGP by providing all relevant documents and assistance to it.

The AGP was directed to commence the audit of the ETPB accounts afresh and complete the procedure within two months.

The court also asked the ETPB to explain how the properties of the board could be sold out when it was told that three properties had been sold to the Defence Housing Authority, Lahore, Multan Development Authority, and a private citizen, Talib Hussain. The court also issued notices to the buyers of the properties.

Dr. Vankwani informed the court that there were 1,809 temples or shrines in the country of which 588 were Gurdwaras and 1,221 Hindu Mandirs and most of them were non-functional.

All these properties stretched on 109,369 acres with an approximate worth of Rs219bn of which 75,055 acres have been leased out to different parties.

The Sindh inspector general informed the court that an FIR had been registered over the complaint of death threats issued to Dr. Vankwani.

سپریم کورٹ نے منگل کو وفاقی تحقیقاتی ادارے (ایف آئی اے) کو ملک کے مختل�� حصوں میں 7,143 شہری جائیدادوں کی فروخت میں 77 ارب روپے سے زائد کی مبینہ بے ضابطگیوں کے بارے میں آڈیٹر جنرل آف پاکستان (اے جی پی) کی رپورٹ پر انکوائری کرنے کا حکم دیا۔

چیف جسٹس گلزار احمد کی سربراہی میں سپریم کورٹ کا دو رکنی بینچ پاکستان ہندو کونسل (پی ایچ سی) کے سرپرست ڈاکٹر رمیش کمار ونکوانی کی جانب سے دائر درخواست کی سماعت کر رہا تھا جس میں شکایت کی گئی تھی کہ اقلیتی برادریوں سے تعلق رکھنے والی جائیدادوں کے تحفظ کے بارے میں عدالت عظمیٰ کی ہدایات پر عمل درآمد نہیں کیا جا رہا ہے۔ عدالت نے ایف آئی اے کو ایک ماہ میں انکوائری کرنے کا حکم دے دیا۔

یہ ہدایت اس وقت جاری کی گئی جب عدالت عظمیٰ کو بتایا گیا کہ اے جی پی نے بے ضابطگیوں کا پتہ لگایا ہے حالانکہ ای ٹی پی بی نے مکمل مدد نہیں کی اور آڈیٹرز کو صرف آدھی معلومات شیئر کیں۔

اقلیتوں کے حقوق پر ایک رکنی کمیشن کے سربراہ ڈاکٹر شعیب سڈل نے اے جی پی کی آڈٹ رپورٹ کو اجاگر کیا تھا۔

عدالت نے ای ٹی پی بی کو حکم دیا کہ وہ اے جی پی کو تمام متعلقہ دستاویزات اور مدد فراہم کرکے مکمل تعاون کرے۔

اے جی پی کو ای ٹی پی بی اکاؤنٹس کا دوبارہ سے آڈٹ شروع کرنے اور دو ماہ کے اندر طریقہ کار مکمل کرنے کی ہدایت کی گئی۔

عدالت نے ای ٹی پی بی سے یہ بھی کہا کہ وہ وضاحت کرے کہ بورڈ کی جائیدادیں کیسے فروخت کی جا سکتی ہیں جب یہ بتایا گیا کہ تین جائیدادیں ڈیفنس ہاؤسنگ اتھارٹی، لاہور، ملتان ڈویلپمنٹ اتھارٹی اور ایک نجی شہری طالب حسین کو فروخت کی گئی ہیں۔ عدالت نے جائیدادیں خریدنے والوں کو بھی نوٹس جاری کر دیئے۔

ڈاکٹر وانکوانی نے عدالت کو بتایا کہ ملک میں 1,809 مندر یا درگاہیں ہیں جن میں سے 588 گوردوارے اور 1,221 ہندو مندر ہیں اور ان میں سے زیادہ تر غیر فعال ہیں۔

یہ تمام جائیدادیں 109,369 ایکڑ پر پھیلی ہوئی ہیں جن کی مالیت تقریباً 219 ارب روپے ہے جس میں سے 75,055 ایکڑ مختلف پارٹیوں کو لیز پر دی گئی ہے۔

سندھ کے انسپکٹر جنرل نے عدالت کو بتایا کہ ڈاکٹر وانکوانی کو جان سے مارنے کی دھمکیوں کی شکایت پر ایف آئی آر درج کر لی گئی ہے۔
