A two-judge bench comprising Justice Zafar Ahmed Rajput and Justice Muhammad Faisal Kamal Alam observed that if the subject land was required by the Rangers Chief, then the same should be acquired with the law by paying the market price to petitioners.

KDA officers were directed to hand over the possession of the land to the lawful and bona fide allottees after fulfilling the codal formalities.

These directives were passed by the bench during the disposition of a petition filed in 2017, by around 20 KDA officers that submitted that they had been allocated 200 sq-yds plots at the KDA officers cooperative housing society. However, it is the area where the DG Pakistan Ranger’s Bungalow is located.

The bench pointed out that if citizens were facing unnecessary hardships, then even the hardships of the members of the Force will be undermined.

کراچی: ایس ایچ سی نے ڈی جی پاکستان رینجرز کو ہدایت کی کہ وہ گلشن اقبال میں اپنی سرکاری رہائش گاہ سے ملحقہ اراضی کے ڈی اے کو خالی کر دیں تاکہ اسے ہاؤسنگ سوسائٹی کے لیے استعمال کیا جا سکے۔
جسٹس ظفر احمد راجپوت اور جسٹس محمد فیصل کمال عالم پر مشتمل دو رکنی ��نچ نے ریمارکس دیے کہ اگر رینجرز چیف کو متعلقہ اراضی درکار ہے تو درخواست گزاروں کو مارکیٹ قیمت ادا کرکے قانون کے مطابق حاصل کی جائے۔
کے ڈی اے افسران کو ہدایت کی گئی کہ وہ ضابطہ اخلاق کی تکمیل کے بعد زمین کا قبضہ قانونی اور باوقار الاٹیوں کے حوالے کریں۔
یہ ہدایات بنچ نے 2017 میں دائر کی گئی ایک پٹیشن کے نمٹانے کے دوران پاس کیں، جس میں کے ڈی اے کے تقریباً 20 افسران نے کہا کہ انہیں کے ڈی اے افسران کوآپریٹو ہاؤسنگ سوسائٹی میں 200 مربع گز کے پلاٹ الاٹ کیے گئے ہیں۔ تاہم یہ وہ علاقہ ہے جہاں ڈی جی پاکستان رینجر کا بنگلہ واقع ہے۔
بنچ نے نشاندہی کی کہ اگر شہریوں کو غیر ضروری مشکلات کا سامنا کرنا پڑ رہا ہے تو فورس کے ارکان کی مشکلات کو بھی نقصان پہنچے گا۔
